REGULAR MEETING
January 10, 2005
A regular meeting of the Township Council of the Township of Old Bridge was held on January 10, 2005 in the Municipal Complex. The meeting was called to order at 7:30 p.m. by Vice President Gillespie.
Moment of Silence
Vice President Gillespie requested a moment of silence for the armed forces who serve in Iraq and for the father of Councilman Butler who recently passed away.
Deputy Clerk, Stella Ward, announced that pursuant to Section 5 of the Open Public Meetings Act, this meeting has been advertised in the Home News and Tribune and that the next public meeting would be held on Monday, January 24, 2005 in the municipal complex.
Roll call by Deputy Clerk Ward showed the following council members answering present: Councilmen Calogera, Greene, Maher, Volkert, Councilwoman Panos, Vice President Gillespie. Councilman Butler and President Baker were absent. Councilman Testino arrived at 7:43 p.m.
Proclamation - Martin Luther King Day
WHEREAS, Old Bridge Township wishes to pay tribute to CORE (Congress of Racial Equality) for all of their achievements and accomplishments; and
WHEREAS, CORE has dedicated over three decades of the organization's existence to peace efforts and public service within the various organizations of the United Nations; and
WHEREAS, CORE has continuously and unrelentingly advocated for the impoverished and oppressed people of the world through their involvement with grass roots organizations; and
WHEREAS, CORE is working with the United Nations impacting on sustainable economic development by making it a top priority to develop programs and projects to address the basic necessities of food, clothing, shelter and medical care for the indigent people of the world; and
WHEREAS, CORE has labored tirelessly for many critical and sensitive diplomatic assignments impacting on the disenfranchised and destitute people of the world, including refugees, hostages and other victims from some of the world's poorest countries; and
WHEREAS, CORE's innovative hands-on approach has helped to solidify the entire United Nationals organizational structure through interaction with field operations staff and personnel at duty stations throughout the world to ensure a full understanding of the United Nation's goals and objectives.
NOW, THEREFORE, I, Mayor James T. Phillips and the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey do hereby honor and salute the CORE organization for all of their achievements and commitment to support the international community a whole. We further extend our best wishes to CORE's future endeavors and for upholding the Martin Luther King, Jr. traditions by practicing human care within the United States and around the world.

Prior to the roll call vote the following discussion took place.
Councilman Calogera: Were there mitigating circumstances for the amount of this payroll? We fluctuate with overtime, and I don't understand the reason.
Mr. Shah: During that period, the road department had overtime of over $8,000 which was snow related during the early morning hours.
Councilman Maher: Who reviews charts that you show the summary of overtime from December 24k, 2004 and the first week of January? Do you contact the departments and use this chart as a management tool? If the departments are running high on overtime, does someone from your staff contact the department to determine what the deviation or the spike increase?
Mr. Jacobs: We maintain a different spread sheet for monitoring police overtime. We know it right to the month.
Councilman Maher: I am referring to Mr. Shah's spread sheet.
Mr. Jacobs: [Mr. Shah's] numbers come from that sheet.
Councilman Maher: I bring your attention to 12/24/04 overtime. This is half of our fiscal year. Some of these departments are running 60 to 70% of their overtime. Can you report back to us at the next meeting? If they have used this percentage, are they going to be on track, or do we need to recommit overtime dollars?
Mr. Shah: The chart is to help the administration and the departments review the overtime status. In some cases we are aware that they are exceeding their allocated overtime budget because there is a vacancy that requires work from others. The vacancy fills up the dollar needed for the overtime overage. We are looking at it and communicating with the departments. As this report goes to you, it also goes to the departments and it is reviewed, and we discuss it. I can try to get you information from some of the departments.
Councilman Maher: Please summarize what is happening with those departments who are at 60 and 70% of their overtime.
Councilman Calogera: There are twelve different areas where we have overtime which exceed the 60+ percentile. We are just at the 50% part of our year. I don't want to see the overtime get out of line and see overruns in July.
Ordinance for First Reading
TOWNSHIP OF OLD BRIDGE ORDINANCE NO. 01-05
AN ORDINANCE OF THE TOWNSHIP OF OLD BRIDGE ACCEPTING STREETS WITHIN THE CEDAR RIDGE DEVELOPMENT FOR USE AS PUBLIC ROADS
BE IT ORDAINED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey as follows:
Section 1. Purpose
This ordinance formally accepts streets within the Cedar Ridge development for use as public roads and permits the enforcement of the traffic laws of New Jersey Statutes Title 39.
Section 2. Ordinance
The Township of Old Bridge formally accepts the following roads in their entirety for use as public roads:
Gates Court North, Rutledge Court, Ortley Court, Pemberton Drive, Rutledge Court South, Rutledge Court, Wainright Drive, Winston Drive
Section 3. Inconsistent Ordinances
All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency.
Section 4. Partial Invalidity
If any section, paragraph, clause or provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, clause or provision so adjudged and the remainder shall be deemed valid and effective.
Section. 5. Effective Date
A. Except as set forth at subparagraphs B and C hereof, this Ordinance shall take effect on the earlier of the following dates: (1) on the date the Mayor affixes his/her signature thereto and returns same to the township council by delivering to the Township Clerk pursuant to N.J.S.A. 40A:69A-41 or (2) on the tenth day following presentment to the Mayor of the ordinance pursuant to N.J.S.A. 40:69A-41 applicable when the Mayor has failed to return the ordinance, whichever occurs first.
B. If the Mayor vetoes the ordinance (in the manner set forth at N.J.S.A. 40:69A-41), this Ordinance shall become effective upon the Township Council's vote to override the Mayor's veto.
C. Notwithstanding any other provision hereof, this Ordinance shall not take effect less than twenty (20) days after its final passage by the Township Council and approval by the Mayor, where such approval is required, unless the Township Council shall have also adopted a resolution declaring an emergency and at least two-thirds (2/3) of all the members of the Township Council vote in favor of such resolution.

TOWNSHIP OF OLD BRIDGE ORDINANCE NO. 02-05
AN ORDINANCE OF THE TOWNSHIP OF OLD BRIDGE AMENDING CHAPTER 2, SECTION 14.9, DEPARTMENT OF PUBLIC SAFETY "SPECIAL LAW ENFORCEMENT OFFICERS"
Section 1. Purpose
This ordinance is adopted for the primary purpose of amending Chapter 2, Section 14.9 "Special Law Enforcement Officers", Department of Police, of the Code of the Township of Old Bridge as follows:
Section 2-14.9 Subsection "n" shall be amended by adding the following sentence to the end of the section:
n. No full time Township of Old Bridge employee shall be first appointed as a Special Law Enforcement Officer for the Township of Old Bridge after February 1, 2005.
Section 2. Inconsistent Ordinances

Consent Agenda
Vice President Gillespie opened a public portion on the Consent Agenda.
Ms. Seiler: Please tell me if Glen Kurtz is related to Frederick Kurtz who is on the redevelopment board.
Mayor Phillips: Fred Kurtz is the executive director of the redevelopment agency. Bill Kurtz is his brother, and Glen, I believe, is Bill Kurtz' son. What does that make him, a nephew?
Ms. Seiler: In the future I request that the names of people and firms be listed here [on the agenda]. I had to go to the clerk's office, and they were very obliging in giving me the information, but I think it would be helpful when we name the people when we are appointing someone.
Mayor Phillips: I believe that there are more people involved in the company called Risk Managers than just Glen Kurtz. They are located here in Old Bridge on Jocama Boulevard.
Ms. Seiler: Is he the principle?
Mayor Phillips: I know Glen Kurtz was a risk manager when they worked for South River, but exactly where Glen Kurtz is in the food chain at Risk Management, I don't know.

RESOLUTION NO. 39
ESTABLISHING INTEREST ON DELIQUENT TAXES
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, that:
WHEREAS, R.S. 54:4-67 permits the governing body of each municipality to fix the rate of interest to be charged for nonpayment of taxes or assessments subject to any abatement or discount for the late payment of taxes as provided by law;
WHEREAS, R.S. 54:4-67 permits the governing body of each municipality to fix the rate of interest for the nonpayment of other municipal liens and solid waste utility charges; and
WHEREAS, R.S. 54:4-67 has been amended to permit the fixing of said rate of 8% per annum on the first $1,500.00 of the delinquency and 18% per annum on any amount in excess of $1,500.00.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, as follows:
1. The Tax Collector is hereby authorized and directed to charge 8% per annum on the first $1,500.00 of taxes becoming delinquent after due date and 18% per annum on any amount of taxes in excess of $1,500.00 becoming delinquent after due date, subject to any abatement or discount for the late payment of taxes as provided by law.
2. The Utility Revenue Collector is hereby authorized and directed to charge 8% per annum on solid waste utility charges becoming delinquent after due date.
3. No interest shall be charged if payment of any quarterly tax payment is made within ten (10) days of the date upon the same becomes payable.
4. In connection with any delinquency of taxes, assessments or municipal charges in excess of $10,000 which has not been paid prior to the end of a fiscal year, there shall be imposed a penalty in the sum equal to 6% percent of the delinquency in excess of $10,000.
5. With respect to tax certificates held by the municipality in excess of the sum of $200, the following additional penalties shall be charged: two (2%) percent on the amount due over $200 up to $5,000; four (4%) percent of the amount due over $5,000 up to $10,000; and six (6%) percent on the amount in excess of $10,000.
6. Any payments not made in accordance with paragraph two of this resolution shall be charged interest from the due date as set forth in paragraph one of this resolution.

AUTHORIZING PAYING OFF BALANCE OF OUTSTANDING BOND ANTICIPATION NOTES FROM THE OPEN SPACE TRUST FUND IN THE AMOUNT OF $1,084,796.00 FOR CEDAR RIDGE II
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, that:
WHEREAS, the Cedar Ridge II litigation has been completed by settlement and the amount of condemnation award has been determined; and
WHEREAS, the unfunded balance of the debt previously authorized for the Cedar Ridge II purchase is $1,084,796.00; and
WHEREAS, the amount to pay off the balance of the outstanding Bond Anticipation Notes held by Amboy National Bank equals $1,084,796.00; and
WHEREAS, the payoff funds are available from the Open Space Trust Fund; and
WHEREAS, a Certificate of Availability of Funds No.1302 in the amount of $1,084,796.00 has been issued; and
WHEREAS, the Capital Budget should be amended to include the payment of the Bond Anticipation Notes in the amount of $1,084,796.00.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge that the Finance Director is hereby authorized to pay off the balance of the Bond Anticipation Notes in the amount of $1,084,796.00 for Cedar Ridge II from the Open Space Trust Fund; and
BE IT FURTHER RESOLVED, that the Capital Budget is hereby amended to include the payment of the Bond Anticipation Notes in the amount of $1,084,796.00.

RESOLUTION NO. 41
AUTHORIZING INTER-LOCAL SERVICES AGREEMENT WITH THE BOROUGH OF SAYREVILLE
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, that:
WHEREAS, the Township of Old Bridge is authorized to enter into an Inter-Local Services Agreement with the Borough of Sayreville pursuant to N.J.S.A.40:8A-1 et seq; and
WHEREAS, the Township of Old Bridge may enter into an Inter-Local Services Agreement with the Borough of Sayreville for the use of the Sayreville jail cells while the Old Bridge jail cells are under reconstruction; and
WHEREAS, the Old Bridge Township Business Administrator shall act as the agent for the Township of Old Bridge in regard to the joint agreement with the Borough of Sayreville concerning the above referenced use of jail cells; and
WHEREAS, said joint agreement shall be signed by the Mayor and Township Clerk after review as to form and sufficiency by the Township Attorney; and
WHEREAS, a copy of the signed agreement shall be available for inspection in the Office of the Township Clerk.
NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey hereby authorizes the execution of an Inter-Local Services Agreement with the Borough of Sayreville for use of the Sayreville jail cells while the Old Bridge jail cells are under construction; and
BE IT FURTHER RESOLVED, that the Mayor and Township Clerk are hereby authorized to sign the Inter-Local Services Agreement after approval by the Township Attorney.

BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, that:
WHEREAS, the Information and Assistance Grant has a remaining outstanding balance; and
WHEREAS, it is necessary to formally cancel the outstanding grant balance listed below:

Prior to the roll call vote the following discussion took place.
Councilman Greene: Please tell me why C-1 (rescinding Resolution No. 588-04 release of performance guarantee for Town Centre for failure to comply with requirements within specified time) has been removed.
Mr. Vincenti: They have satisfied all the conditions of the approval. There was a requirement for posting of a bond which came in last week. There was the need to get a confirmation from the NJDOT that the traffic signal being accepted by the State, and that documentation has been received. They have satisfied the conditions of the bond release. The resolution is no longer appropriate.
Attorney Convery: We did not take any official action on this resolution. It has been removed because it is moot.
RESOLUTION NO. 43
AUTHORIZING THE APPOINTMENT OF GLEN KURTZ, RISK MANAGEMENT CONSULTANT
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, that:
WHEREAS, the Township of Old Bridge requires the services of a professional risk management consulting firm; and
WHEREAS, Glen Kurtz is a licensed risk manager of Governmental Risk Management Associates, whose firm is recognized as capable and available to undertake such work; and
WHEREAS, the Township Council wishes to authorize the appointment of Glen Kurtz, Risk Manager, for his professional consulting services for the calendar year 2005.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, as follows:
1. A contract for professional services is authorized to be entered into with Glen Kurtz as risk management consultant, located at Two Jocama Boulevard, Old Bridge, NJ 08857.
2. The Mayor and Township Clerk are hereby authorized to sign the contract documents necessary to effectuate the award of the contract. The Township Attorney shall review any and all contractual documents prepared in furtherance of this award.
This resolution is conditioned upon the following:
A. Formal execution of a contract approved by the Director of Law which is signed by the Mayor and Township Clerk.
B. Compliance by the vendor with signing the mandatory affirmative action language required by law.
C. Compliance by the vendor with filing of Affirmative Action Form AA302 or AA201 or otherwise complying with Affirmative Action Employee Information Reporting.
No contract shall be considered awarded unless and until the above requirements are executed.

Prior to the roll call vote the following discussion took place.
Councilman Calogera: We employed Risk Management in the past, correct?
Mr. Shah: They were appointed when we originally joined the Central Jersey JIF. This is a renewal of their appointment as a risk manager.
Councilman Calogera: How do they get paid?
Mr. Shah: Every municipality has a risk manager. All the managers get paid from funds collected.
Councilman Calogera: We pay into the JIF, and the JIF pays them?
Mr. Shah: Yes.
Councilman Calogera: Has our donation to the JIF been similar from last year to this year?
Mr. Shah: We had a 2.7% increase over last year as our contribution to the JIF.
Public comments on any subject matter.
Mrs. Springer: Addressed the council as to the dangers of making a right hand turn into Inverness Drive because drivers use the shoulder as a lane.
Vice President Gillespie: I request Mr. Jacobs to contact the DOT.
Seeing no further hands Vice President Gillespie closed the public portion.
Mayor's Comments
Mayor Phillips: It has come to may attention that at the last meeting there was a workshop that was scheduled for February 7, 2004. I ask the council's indulgence in rescheduling that and notifying you when that meeting will be on January 24. I have asked Mike Jacobs to try to get the Bush Center and to try to make it a more lengthy process. I don't know that one and one-half hours will be enough. Between now and January 24 we will come up with a new date, and we will notify everyone who was notified before. I am referring to the workshop for the COI. There are two factors - the most important is time. We had scheduled this before a council meeting which may have only left an hour. I thought that we could break this down into sections, and perhaps have John Vincenti at one corner and Sam Rizzo and other professionals [at another] so that people could come up with exactly the property that was identified and how the zoning may affect them whether it is just neighboring property; whether there is an application. This would give it more time and information. If the residents need copies of the maps, we could make the arrangements for them that night.
Vice President Gillespie: Having it in the Bush Center will provide a less formal setting so that people can have their questions answered in a less formal way. Not everyone likes to get up at council meetings to speak and ask questions so that having this type of format will be beneficial.
Mayor Phillips: The most important for people to know is that no action will be taken that night.
Council comments
Vice President Gillespie: Councilman Butler's father has passed away. Cards and condolences may be sent to his home. His father lives in South Carolina so that there will not be a viewing here.
Councilman Maher: I noticed that at the former Home Depot parking lot on Rt. 9 north there is commuter parking. Is there activity at that building that we should know about?
Mr. Jacobs: We do operate a commuter parking lot there. We don't charge for it.
Mayor Phillips: There is a parking lot at Ernston Road which has been commuter parking for Old Bridge residents only which has been there for years. There is also an arrangement with Home Depot that they would provide parking spaces for commuters. I have been told that the people who occupy those spaces do not have to be township residents. Are we operating that lot? It is permission from Home Depot to use it as a parking lot. We are operating the commuter lot at Ernston Road, where we are collecting one dollar a day from people, and they need a parking permit to park there. I was not sure if we had the same lot in mind, but the one in front of Home Depot was provided for commuter parking places. People use that, but we don't collect money for using it.
Councilman Maher: I was referring to the Home Depot parking lot which was full.
Vice President Gillespie: The lot that we operate is the closest to the bus.
Councilman Greene: If we have an arrangement with Home Depot, shouldn't we require that the people who park there pay $25 for a permit like everyone else? We have the facility on Jake Brown Road which is owned by Mr. Brunetti, and in order to park there you must have a $25 permit. There are a group of people who can park in an area by Home Depot who don't have to buy a permit nor pay $1 per day. I wonder if the agreement that we have Home Depot includes snow removal. I would hate to think that we are removing the snow and not charging to park there.
Mayor Phillips: I will look into that to determine just what the agreement is. This [the parking lot] is being used while there is no tenant. I hate to charge someone for a permit only to find out that Home Depot is going back into business and won't allow parking. Between now and the next meeting, we will investigate this to get answers.
Councilman Greene: There is a concern about providing sufficient parking for our residents. I question this in the light of making this fair for everyone.
Mayor Phillips: This may entice more people to park at the Inverness Drive or the park and ride facility. It is a good question, and I know that this has been discussed with Russ Azzarello and what the intentions are and when the lease could be up. There is just that contingency about when Home Depot will be leased to someone else and when the parking spaces will be withdrawn from use by the public.
Vice President Gillespie: This may have been a prior condition from when we first went into that lot with New Jersey Transit. We may not just be able to say that we can do what we want. That is a good question, and I am sure the administration will look into this for us.
