AGENDA MEETING

February 20, 2001

An Agenda meeting of the Township Council of the Township of Old Bridge was held on February 20, 2001 in the Municipal Complex. The meeting was called to order by Vice-president Butler who asked all present to participate in a salute to the flag which was followed by a short prayer.

Deputy Clerk Stella Ward announced that this meeting is being held in conformance with the open public meetings act, notice has been given to the newspaper and notice of the meeting has been posted in public places.

Roll call at 8:07 p.m. by Deputy Clerk Stella Ward, showed the following members present: Councilmen Greene, Hoff, Redmond, Testino, Sohor, Councilwoman Marinaccio, Vice-president Butler. President Maher and Councilman Cucchiara were absent.

WORKSHOP - 7:00 p.m.

Taxicab/Limousine Ordinances

Vice-president Butler: I would like the council members present at that meeting to give the rest of the council an over view.

Councilman Redmond: We have decided to amend the existing ordinance to increase the fees and to require photographing and fingerprinting applicants. We will still keep this ordinance as a work in progress.

Councilman Greene: The proposed ordinance is pretty extensive. We focused on the fees and we realized that we need further research on other issues and possibly another workshop.

Vice-president Butler: The Clerk's office will be inundated with renewals in March. The legal department will put something together for first reading Monday so that we can move this along. I think that we should set up another workshop for two weeks from now.

Deputy Clerk Ward: March 19, 2001 is the date.

H-1 Release/Reduction Performance Guarantee - Park's Edge

Pinder Sumal; Assistant Township Engineer, Brian Whitehead; Attorney for Park's Edge, Wayne Levy; for the developer J&D Development Corporation

Mr. Sumal: This development is for nine single family homes, there are currently four certificates of occupancy issued. The road and curbing is installed, the detention basin, utilities and lighting are in. Based on our estimate on the work done so far, we are recommending a 50% reduction.

Vice-president Butler: What are those figures?

Mr. Sumal: The performance bond from $249,035.85 to $124,517.92. The cash would be reduced from $27,670.65 to $13,835.32.

Mr. Whitehead: We are in agreement with this recommendation.

Councilman Hoff: Why are we moving so quickly to reduce on a developer that is not even half complete? Can I assume that the complaints from nearby residents have been satisfied?

Mr. Sumal: Yes. The complaints last time were about stock piling earth and that has been removed and graded.

Councilman Hoff: Have the walkways been taken care of?

Mr. Sumal: It is satisfactory to me.

Vice-president Butler opened the public portion. Seeing no hands Vice-president Butler closed the public portion.

To reduce the performance bond by 50% on the recommendation of the engineer by Councilman Hoff, seconded by Councilman Sohor and so ordered on the following roll call vote:

ORDINANCE FIXING COMPENSATION OF DEPARTMENT HEADS PURSUANT TO N.J.S.A. 40:69A-180 AND THE TOWNSHIP TAX ASSESSOR

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, as follows:

1. Compensation for Department Heads shall be fixed as follows (base salary subject to longevity):

2. Additional compensation for Department Heads shall be as follows:

All health, prescription, vision, long-term disability insurances and other similar benefits afforded other full time employees of the Township of Old Bridge, plus any benefits provided by Ordinance.

BE IT FURTHER ORDAINED that the Township Tax Assessor's salary, wages and compensation are fixed to be $81,455 retroactive to July 1, 2000 (See Note 6). Additional compensation for the Township Tax Assessor shall be as follows: All health, prescription, vision, long-term disability insurances and other similar benefits afforded other full time employees of the Township of Old Bridge, plus any benefits provided by Ordinance.

*Note 1. The current incumbent in this position holds the position of Director of Police. This Ordinance does not permit any person to collect dual salaries. Accordingly, the Business Administrator shall be paid only for one position or the other, but not both.

*Note 2. The current incumbent in this position also holds the office of Chief Financial Officer. This Ordinance does not permit any person to collect dual salaries. Accordingly, the Director of Finance may be paid only for one position or the other, but not both.

*Note 3. The current incumbent in this position also holds the office of Township Engineer. This Ordinance does not permit any person to collect dual salaries. Accordingly, the Director of Community Development may be paid only for one position or the other, but not both.

*Note 4. The current incumbent in this position also holds the office of Public Works Supervisor. This Ordinance does not permit any person to collect dual salaries. Accordingly, the Director of Public Works may be paid only for one position or the other, but not both.

*Note 5. The incumbent in this office shall perform additional duties as follows:

(A) Assume a lead administrative role in all Township-Employee labor contract negotiations;

(B) Administer special projects as assigned by the Mayor and Business Administrator; and

(C) Serve as replacement for Business Administrator in her/his absence.

In 1998, this was adjusted beyond the standard percentage increase to compensate for such additional work. Inasmuch as $8,000.00 of this officer's salary constitutes a stipend for the aforesaid temporary duties, the $8,000.00 stipend may be withdrawn at the direction of the Mayor. Longevity shall not be payable with respect to $8,000.00 of the authorized salary.

*Note 6. In 1999, this salary was adjusted by $5,000.00 in specific consideration of the Tax Assessor's assignments outside his role as Tax Assessor, to wit: to assist the Mayor and Council in evaluating and analyzing real estate valuation issues in connection with Township acquisitions of property rights. Except as provided herein, the Tax Assessor may not be paid for additional positions within the Township government. Longevity shall not be payable with respect to the $5,000.00 stipend amount.

*Note 7 The yearly stipends for the Recreation Director and Tax Assessor in footnotes five and six above must be approved by the Mayor and Township Council on an annual basis.

Vice-president Butler: We did not have the correct figures at the last meeting and that is why it is on again for tonight.

Ms. Shepler: I pointed out last week that the ordinance before you reflected the mayor's original recommendation (which was 4 ½%) plus a stipend for certain individuals. Council then said that they would do 3 ½%. Even though the numbers have been changed in the new ordinance that I am looking at (which does reflect 3 ½%) there is a problem with the recreation director and tax assessor in the way it is written. The notes are to include an $8,000.00 stipend to the parks and recreation director and a $5,000.00 adjustment to the assessor, the way that it is written now, because the number has been backed out, it has no meaning, it means if you vote on this tonight the way it written (if you intend to give those stipends) you will have to vote another ordinance.

Vice-president Butler: I thought we were giving the department heads the same increase as the union members received.

Ms. Shepler: If you were to leave this the way it is written you would be giving Mr. Badcock an $8,000.00 decrease over last years salary. Is that council's intention?

Councilman Testino: Where is the ordinance?

Ms. Shepler: It should be in your packet, I've had it since Friday.

Vice-president Butler: So if we voted 3 ½% we would be giving Tom a decrease?

Ms. Shepler: No. The first ordinance was for 4 ½%, you said that you didn't want to do that. I redid the figures to reflect the 3 ½% increase. Those numbers have always included the stipend with the note. It says it may be drawn at the discretion of the mayor and it not subject to longevity. That was the ordinance that I gave to the clerk's office the other day, when I came in today I found that it had changed again. If you look at the base salary on the first page it reflects a salary of $82,360.00 and makes no stipulation for that $8,000.00 stipend.

Councilman Testino: Who changed the ordinance?

Ms Shepler: It had to come from the Clerk's office, it didn't come from mine.

Councilman Hoff: I recall that the feelings of the council was that they were willing to increase similar to that which was given to the contracted employees in town and to deal with stipends and other requests of the mayor at a later date. I think the motion was clear enough, not amounts over 3 ½ %.

Ms. Shepler: That will be a cut in two salaries from last year. You accepted those stipends last year, this is not something new that just came up this year.

Vice-president Butler: We are not looking to reduce anybody's salary.

Ms. Shepler: That is what this ordinance will do.

Vice-president Butler: Then change the ordinance because we don't want to reduce anyone's salary.

Councilman Hoff: We talked about adjusting the stipends at a later time.

Ms. Shepler: Why would you cut an employee's salary who has been performing these jobs? In the case of the three new categories it was my salary, finance, and law. The assessor's and recreation director's salaries have been in effect since 1998 and 1999.

Councilman Testino: When is the mayor coming back?

Ms. Shepler: On February 28th.

Councilman Hoff: We should leave this the way it is and discuss the stipends with the mayor.

Ms. Shepler: I have the mayor's full authority to present these stipends.

Councilman Hoff: Well we are not going to pay them.

Ms. Shepler: Then in effect, you have cut two employees salaries.

Councilman Hoff: It is not a cut.

Ms. Shepler: They were given the stipend and that is their base salary.

Councilman Hoff: The stipend is not part of the salary.

Ms. Shepler: That is the way it has been for two years ago.

Councilman Hoff: It says it can be cut at the discretion of the mayor.

Ms. Shepler: She has no intention of cutting that and she told me so, before she left.

Councilman Hoff: Well maybe she isn't the only one who has discretion.

Ms. Shepler: Well then you are in effect cutting two salaries.

Mr. Badcock: I have had this salary for three years and I have been doing negotiations since 1992 in town, I didn't get paid until 1998. This is not part of the new adjustments, this is my salary. Since it has been instituted there has been one number, which is what I get paid, of which, $8,000.00 is not eligible for longevity, that is the way it has always been written. The way it is written now is to cut the entire salary $8,000.00. Of course I have a problem with that because this is work that I have been doing.

Councilman Hoff: Nobody has a personal vendetta against you, but we are not here to grant the mayor's Christmas list. We have a right to discussion, we are not going to be told what to pay. We are being fair and giving the same basic salary increase we gave to other workers. We can discuss stipends later.

Mr. Badcock: Then I am getting a cut of $8,000.00 for work that I have already done.

Vice-president Butler: No you aren't.

Mr. Badcock: Yes I am, that is the way the ordinance is written.

Councilman Greene: I was given several proposals from administration, the concern I had was that no one ever told me how they got to the final number. I figured it out one time and the second year of increases ranged from 4 ½% to 9%. I objected to that, I didn't know what the difference was between 3 ½ and how the administration got; in some cases 9%. As far as Tom Badcock and Brian Enright, the council decided to give this to them several years ago and it should continue and it should not be part of this discussion. Even though we are giving the 3 ½% retroactive, Tom has been getting this $8,000.00 from the beginning of the year; in effect, if we change midstream, it would be giving him a pay cut and I don't think that is fair.

Vice-president Butler: Will the finance director be here tonight?

Ms. Shepler: He said he would come back if he felt better.

Vice-president Butler: I would like to put this together as the council made it known at the last council meeting. We are not cutting anyone's salary, all we talked about was giving the department heads the same 3 ½ % that the employees received. Alayne, can you ask the finance director to put together an ordinance, so that we can have that Monday evening?

Ms. Shepler: You have that in front of you, those number reflect 3 ½%, with the exception of Tom and Brian, all you have to do is add back the $8,000.00 for Tom and $5,000.00 for Brian.

Vice-president Butler: Can you tell this to the finance director, so we can vote Monday?

Ms. Shepler: You have the numbers in front of you. Those numbers are 3 ½ %. On note 5 it says "this number includes $8,000.00 which is a stipend". Every other number is correct. The notes need to be changed or the figures.

Councilman Hoff: Are you telling me that we can't pass an ordinance with a 3 ½ % increase and discuss the stipends at a later date.

Ms. Shepler: No. You are cutting Brian and Tom's salary.

Councilman Hoff: When does the salary start?

Ms. Shepler: It started July 1, 2000. The minute this ordinance passes, they will get a salary cut.

Councilman Hoff: Are all stipends at the discretion of the mayor, with approval of council?

Ms. Shepler: Yes.

Councilman Hoff: The council has chosen not to approve these stipends.

Ms. Shepler: Are you are telling me that you are cutting the director of parks and rec. $8,000.00 and the tax assessor $5,000.00?

Councilman Hoff: No.

Ms. Shepler: This is less then he received last year.

Councilman Hoff: We can discuss stipends at a later time.

Ms. Shepler: How come there was nothing to discuss at a later time when we got to other people's salaries? There have been other stipends given, there was 25% increase given in an office.

Councilman Hoff: I don't know what you are talking about.

Ms. Shepler: It was in the Clerk's office and those didn't require discussion.

Vice-president Butler: Will Mr. Shah be in tomorrow?

Ms. Shepler: I hope so.

Vice-president Butler: I will meet with Mr. Shah and have this ready for Monday the way it should be.

DISCUSSION ORDINANCE

DO-1 Ordinance to purchase the Jacobs Property - Central Ave. - Block 26015 - Lot 290

Councilman Hoff: I don't think that we should act on this until we have further explanation and clarification.

Councilman Testino: I thought we decided not to do this, why is it back on?

Vice-president Butler: Why don't we refer this to open space and let them give us a recommendation.

Councilman Testino: Is the administration supporting this?

Ms. Shepler: This matter in under appeal at the current time.

Councilman Testino: You can send it there, but it shouldn't even be on the agenda.

Vice-president Butler: Do you want to send it?

Ms. Shepler: So you want me to do that?

Vice-president Butler: Yes.

DO-2 Amendments to Environmental Commission Ordinance, Associate Members (BH)

Councilman Testino: I would like to also include appointments from the council along with the mayor. I think that this is a great thing. We might want at least three members. I think once we start making appointments you will see some interest.

Councilman Redmond: Do we presently have student members on the environmental commission?

Ms. Shepler: No, there is no provision for associate members.

Vice-president Butler: Do you want to move it up?

Councilman Testino: Yes, with my amendment.

Councilman Redmond: Are we talking about high school kids?

Councilman Testino: They are mostly upper grades. There may be other organizations that will have an interest in this. I think the ordinance envisions upper grades.

Councilman Redmond: I think this is a wonderful idea for the youth.

D0-3 Proposed Capital Projects (HS)

Councilman Testino: I would like to have a workshop for this with Mr. Shah.

Ms. Shepler: We would like that.

Vice-president Butler: March 5th before the agenda meeting at 7:00 p.m.

DO-4 Amending Police Ordinance - minimum qualifications. (RNS)

Councilman Hoff: I read the recommendation and they sound well developed but I would refer this to the police department for their comments before we take any action.

Councilman Sohor: Now is a good time for changes in the police ordinance because we have a new list and there won't be a list that this would affect for another two years. Having looked over the new officers that we've got coming into the department, they will meet these requirements. The people who are applying are more educated and experienced. I think that we should codify what is happening in the real world into our police ordinance so that we can let people know that we are looking for the best candidates and it will upgrade the department as a whole. Police work gets more complicated and requires a lot more skills. I think that by giving some additional preference in the entry level to people that have had involvement in our volunteer services, I think that is a way to send the message to our young people that we appreciate the free time that they give to the fire and first aid, specials and auxiliary. I would like to see this move along.

Vice-president Butler: Are you making a recommendation to the police department?

Councilman Sohor: It is to council, we pass the ordinances and set the requirements. I think that these are common sense. These are equal to or less then most departments in the State of New Jersey. They are also in-line with the recommendation of the County Prosecutor for minimum standards for police officers.

Vice-president Butler: I think that we should have some input from the police department.

Councilman Sohor: Obviously, they are entitled to it.

Vice-president Butler: Alayne, can we send something to the police department?

Ms. Shepler: I don't have anything in my packet.

DR-14 Amending Municipal Land Use Law requiring posting of application notices. (RNS)

Councilman Sohor: This and DR 15 should be discussion ordinance not resolution, I filled in the wrong box. I have given you a sample of the posting. This will be for development, not for someone adding a porch or a pool. One of the complaints that we hear is that only people within 200 feet are notified. A simple notice that states the developer, application number, and description and where people can get information. This should be done before the application is approved. If you are in agreement, we need to move this to the planning board.

Councilman Testino: Is there a trigger when we put the sign up?

Councilman Sohor: I envision any type of new construction.

Councilman Testino: I would like legal to see what the trigger should be.

Vice-president Butler: So let's move this up.

DR-15 Amending Municipal Land Use Law - amending requirements for multiple access roads in new developments. (RNS)

Councilman Sohor: When we had a gas leak on Morganville Road, opposite Yardley Manor, it was directly in front of the one road leading into that development. We have in the Land Use Ordinance a requirement that developments have two separate ingress and egress. Yardley Manor has two entrances, the problem is that one of them hasn't been built yet. I was talking with emergency services and we should have a provision that until a second entrance is built, that we should require a second way for emergency personnel be able to enter a development, as long as there are occupancies in development. I don't think this will be a major burden to developers. I would like legal to draw something up for presentation to the planning board.

Vice-president Butler: Will Bill have an easement ready for Monday so that we can vote on it?

Mr. Condon: I know that he is preparing a memo to council which will explain this.

Mr. Sumal: We have drawn an easement and it needs to be tied to a monument. That we can not do. We have to put the description of the metes and bounds.

Ms. Shepler: I think Pinder is telling you that he needs an outside surveyor and that he needs the metes and bounds description.

Vice-president Butler: Are we pulling this?

Councilman Testino: Are we adopting an easement and accepting it?

Vice-president Butler: Let's see how much progress you make by Monday and we can always take it off.

Mr. Sumal: Nelson will be here on Monday.

D-2 Jacobs Property - Joining Grau Appeal (RNS)

Councilman Sohor: We voted last week by a tie vote not to join this appeal. We voted after the executive session and there were no members of the public here and three members were missing. I put this back on so that we could do a public vote and hopefully everyone will be here.

Councilman Testino: We did do a public vote.

Councilman Sohor: There was no one here, it was close to midnight and the member of council that is from that area was not able to attend the meeting.

Vice-president Butler: OK we will move it up.
