REGULAR MEETING

October 22, 2001

A Regular meeting of the Township Council of the Township of Old Bridge was held on October 22, 2001 in the Municipal Complex. The meeting was called to order by President Maher who asked all present to participate in a salute to the flag which was followed by a short prayer.

Deputy Clerk Stella Ward announced that this meeting is being held in conformance with the open public meetings act, notice has been given to the newspaper and notice of the meeting has been posted in public places. Next meeting of the Council will be November 8, 2001 at 7:30 p.m.

Roll call at 8:01 p.m. by Deputy Clerk Stella Ward, showed the following members present: Councilmen Butler, Greene, Hoff, Redmond, Sohor, Testino, Councilwoman Hegarty President Maher. Councilman Cucchiara was absent.

Presentation to Rose-Marie Saracino, Township Clerk - 30 Years of Service

Councilman Redmond: We have a very valued employee and I am honored to present this plague to the Township Clerk for her 30 years of continuous service to this township. The plaque reads:

In recognition for your 30 years of devoted service to the Township of Old Bridge, your commitment to the community exemplifies a true spirit of civic pride, your spirit and dedication is invaluable and sincerely regarded. Congratulations on 30 years of service, presented this 22nd day of October

RESOLUTION #494

BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:

WHEREAS, the Township Council of the Township of Old Bridge wishes to recognize thirty (30) years of faithful and continuance service by Rose-Marie Saracino, the Township Clerk of the Township of Old Bridge; and

WHEREAS, Rose-Marie Saracino is a valued officer of the municipality who holds certifications as both a Registered Municipal Clerk and a Certified Municipal Clerk; and

WHEREAS, the efficiency, diligence and knowledge of Rose-Marie Saracino is a great asset to the Township of Old Bridge, its government and its citizens; and

WHEREAS, among the many other accomplishments of Rose-Marie Saracino she has recently seen to the modernization of the Township Clerk's office and has improved the systems therein; and

WHEREAS, the Township Clerk's office under Rose-Marie Saracino's leadership has been responsive to the needs of Township officials and citizens alike; and

WHEREAS, the anniversary of Rose-Marie Saracino's thirtieth (30th) year in service and employment at Old Bridge Township should not go unnoticed.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey as follows:

A. The Township Council does hereby recognize and congratulate Rose-Marie Saracino, Township Clerk of the Township of Old Bridge for her thirty (30) years of continuous service as an employee of the Township of Old Bridge.

B. The Township Council does hereby offer and extend its hope the Rose-Marie Saracino will enjoy many years of future good health and rewarding experiences both in her governmental and her private life.

C. A true copy of this resolution should be suitably framed and delivered to Rose-Marie Saracino as a token of the regard with which she is held by elected officials, other governmental officials and great numbers of the citizens of the Township of Old Bridge.

PRESENTATION

Deputy Chief Tom Hart & Firefighter Robert McDonough for last year's fire at 100 Ticetown Rd

Mayor Cannon: Last year at about this time we had a fire at 100 Ticetown Road, it was early in the morning and these two members put their lives at risk by entering the building to try and rescue residents.

Mayor Cannon presented plaques which reads:

In recognition of the extraordinary job that you did on November 2, 2000 at the fire at 100 Ticetown Road, putting your own life at risk to take care of the residents of this community is most commendable. This award is presented with heartfelt appreciation on behalf of the Township of Old Bridge. Mayor Barbara Cannon and the Township Council.

Mayor Cannon: Thank you both so much. We must remember these volunteers, they have other jobs. They do a wonderful job protecting us.

Preliminary Public Comments

Anthony Cutrone: I would like to know if there is a way for the township to help us out with utilizing the gym space in the school for basketball? We do not have enough space. We are here asking for the township to give us a Saturday. We will have to refund the fees if you don't. Can you find it in the budget to give us a Saturday?

Mayor Cannon: We think that it is doable for the period from now until the end December, assuming they have the space available on Saturdays.

Mr. Cutrone: We may not need all the Saturdays.

Mayor Cannon: You will have to get together with Tom Badcock to work out the times.

Mr. Cutrone: Last year the Old Bridge Basketball Association received $3,500.00 for 800 kids, which worked out to $4.00 a kid. The Old Bridge Youth Athletic Association received $700.00, which came out to about $23.00 a kid. There is a big variance there. It should be equal. I hope that the grant money will be there next year.

Mayor Cannon: We will need cooperation from the council.

Councilman Testino: What would you like?

Mayor Cannon: Tom is saying that it would cost about $800.00 for the time from now until December.

Mr. Shah: When we prepared the budget, the amount appropriated was the amount actually spent last year. So additional money will have to be put in the budget and the budget is in the hands of the council.

Councilman Redmond: Do you need an emergency appropriation?

Mr. Shah: No, when you finally adopt the budget you will have to increase the appropriation in the recreation department. We will give you the number when Tom works out the hours and the amount. I think at the last budget meeting we talked about an adjustment of 6 to 8 thousand dollars.

Councilman Redmond: This goes to the Board of Education.

Mr. Shah: It goes to a private company, a janitor service. In order for the building to be open they need to have janitors there.

Councilman Redmond: Remind them that they are getting $27,000.00 worth of free ice time.

Councilman Hoff: Why is there such a difference in the amount of money per child?

Mr. Badcock: The least amount of money that we give is $500.00. Obviously we can't give an organization with 2000 kids that much money per kid or we would go bankrupt.

Councilman Hoff: Why does one kid get $22.00 and another $4.00?

Mr. Badcock: It is not per kid, it is per organization.

Mr. Cutrone: Is the money going to be there?

President Maher: Yes.

Virginia Estwanick: When the curbing was replaced in Madison Park, they did a lousy job and when they re-seeded they re-seeded with 100% crabgrass. I have brought pictures to show you. I spent three days pulling the crabgrass out and planting grass seed. There are elderly widows that will not be able to do this. What can the township do about this? Doesn't the bid specify that the contractors have to put the landscaping back the way it was?

President Maher: Yes.

Mayor Cannon: It was suppose to be put back the way it was.

President Maher: I would like a report on this from Public Works.

Carol Borbely: I live on Werner Court and am adjacent to two construction sites. They have model homes that they are putting in and they were not suppose to be started because fees were not paid and plans were not signed. I contacted the township today and I understand that with particular developer there were other times that this happened. Private citizens have to have their fees and permits before they can start working, why don't major developers in this township have to follow the rules and even when they complain about it they are not penalized.

President Maher: What two subdivisions are you talking about?

Ms. Borbely: Matchaponix Estates and the one behind it.

President Maher: How did you find out that they didn't pay for their building permits?

Ms. Borbely: I came down to the township.

Mayor Cannon: We will check this out.

Nelson Iglesias: We shut them down.

President Maher: Are we fining them?

Mr. Iglesias: There will be a stop order issued.

President Maher: I want this to be followed up on.

Kevin Calogera: Is our emergency response on a county level? New York sent out a questionnaire to retired police for them to write down expertise and they have tapped the wealth of the community. I think that we have a lot people with diverse backgrounds in medical, chemistry, law enforcement that we may want to build a database on that.

Councilman Sohor: On Thursday, in the Bush Center there is going to be a LEPC meeting and you may want to attend and bring this to their attention.

Mr. Calogera: People need to have information in their homes about numbers to call and if we are organized. I think people need to be reassured that these things are being taken care of.

Mayor Cannon: I just did a program on this before the council meeting started. I want to assure everyone that the township is very well organized. I think Kevin's suggestion has merit and we will look into it.

Barbara York: I have seen in the township the roads that contractors have opened up and are not replaced properly. This is a problem throughout the whole township.

Councilman Hoff: We have an ordinance that deals with this, it is up to residents to bring this to our attention at the time that this is going on. If someone opens up a street it should be replaced better than before it was opened.

Ms. York: We need to do something about Charles Street. I think those people deserve it.

HEARING

Resolution confirming Township Engineer's report on Sidewalk Reconstruction Costs.

RESOLUTION #495

BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:

WHEREAS, the sidewalk reconstruction authorized by Township Ordinance 48-00 has been completed; and

WHEREAS, the Township Engineer has prepared a report setting forth the costs of the sidewalk reconstruction costs which are to be assessed on the properties which have been improved in accordance with N.J.S.A. 40:65-1, et seq., and

WHEREAS, the Township Council must confirm the report of the Township Engineer prior to sidewalk reconstruction costs being assessed on the properties which have been improved;

WHEREAS, the Township Council wishes to confirm the report of the Township Engineer:

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey the report of the Township Engineer setting forth the costs of the sidewalk reconstruction authorized by Ordinance 48-00 which are to be assessed to the properties improved has been properly made and is confirmed; and

BE IT FURTHER RESOLVED that the report of the Township Engineer shall be filed with the Tax Collector who shall record the costs of the sidewalk reconstruction as assessments against the properties that have been improved in accordance with N.J.S.A. 4:65-1, et seq.; and

BE IT FURTHER RESOLVED that such assessments shall be payable in quarterly installments with legal interest thereon for a period not to exceed ten (10) years and that such assessments shall be paid in full upon the sale or transfer of the assessed property.

Mr. Pinder Sumal: We have finished the sidewalk project and we are to submit the cost which we have to certify according to the ordinance. The homeowners were given three choices, they could pay in full, put down a deposit and pay in installments, or pay the whole amount in installments.

President Maher: I have no questions, it is all in our packets. We just need to pass a resolution on this.

Councilman Greene: The feedback that I have on this program is satisfaction. The residents that took part in it are very happy. A lot of residents have specifically mentioned the good work that Mr. Sumal has done working with the residents. I would like to thank you on behalf of the residents.

Councilman Hoff: This will be on the tax bill.

Mr. Shah: The amount of assessment will be added to the tax bill, it is a lien on the property.

Mr. Condon: Council is just being asked to do the final step in the sidewalk program. You are just being asked to approve the final amounts which the residents will pay. This was stipulated in the ordinance.

BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:

WHEREAS, there will be a delay in the adoption of the 2002 Township of Old Bridge, County of Middlesex, New Jersey Local Municipal Budget; and

WHEREAS, if additional funds are not budgeted for the following, the public welfare will be adversely affected.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey, that in accordance with N.J.S.A. 40A:4-20, an emergency temporary appropriation be and same is hereby made for in the amount of $1,672,700.00 and that said emergency temporary appropriation shall be provided in full in the 2002 budged (See Attached)

ADDED DURING THE MEETING BY COUNCILMAN SOHOR

New Jersey Terrorism Victims' Assistance Act of 2001

RESOLUTION #500

BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:

WHEREAS, the New Jersey Legislature has enacted and the Governor has signed a bill known as "The New Jersey Terrorism Victims' Assistance Act of 2001" which provides various forms of relief and forbearance for persons affected by the terrorist attack on the United States of September 11, 2001; and

WHEREAS, Section 3 of the bill provides that notwithstanding the provisions of any other law or rule or regulation to the contrary the governing body of a municipality by resolution may temporarily waive interest on any delinquent current property tax obligations or current municipal charges due on or before December 31, 2001 in regard to persons who suffered personal injury, death, loss of a family member, loss of damage to real or personal property, or business interruption as a result of the terrorist attack on the United States on September 11, 2001; and

WHEREAS, the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, does endorse such a waiver and a forbearance with respect to obligations owning to Old Bridge Township; and

WHEREAS, the Township Council does hereby wish to enact an initial authorizing resolution to implement the waivers and forbearance provided in the aforesaid legislation.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey as follows:

1. The Township Council does hereby authorize the waiver of interest on any delinquent current property tax obligations or current municipal charges due on or before December 31, 2001 in regard to persons who suffered personal injury, death, loss of a family member, loss of damage to real or personal property, or business interruptions as a result of the terrorist attack on the United States on September 11, 2001.

    • As a means of implementing the provisions of this resolution the Mayor shall develop sufficient procedures to allow persons covered by this resolution to make application for interest waivers and waivers of municipal charges due on or before December 31, 2001.
    • This resolution shall constitute sufficient authority for the Tax Collector of the Township of Old Bridge to strike interest from the account of any person meeting the criteria of the legislation and this resolution.
    • A true copy of this resolution together with a copy of the bill enacted by the New Jersey Legislature shall be forwarded by the Township Clerk to each of the eleven (11) families which have persons missing or deceased as a result of the World Trade Center disaster.

Prior to the vote the following discussion took place

Councilman Sohor: This will allow municipalities to allow residents that were effected by the act of terrorism on September 11, 2001 to postpone payment of property taxes that are due in the current quarter until the end of the year with out penalties. Mr. Greene and I asked the legal department to draw up such a resolution. The cost to the township is minimal. I believe that taken a step such as this will make life a little easier for all the affected families in town.

WHEREAS, it has been determined that said property was deeded to The State of New Jersey, Department of Transportation on November 6, 1997.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge that the Tax Collector is authorized to cancel Tax Sale Certificate #99122 and refund the certificate amount plus lawful interest to the purchaser.

BE IT FURTHER RESOLVED that the Tax Collector is hereby authorized to cancel any taxes levied after the date of sale to the NJDOT along with any related interest or penalties.

AN ORDINANCE AUTHORIZING ACCEPTANCE OF 15 ACRES OF LAND (WOODHAVEN VILLAGE)

BE IT ORDAINED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey as follows:

Section 1. Purpose

This ordinance is adopted for the primary purpose of accepting fifteen (15) acres of land within the Township of Old Bridge as follows:

Section 2. Acceptance of Property

The Township of Old Bridge does hereby accept fifteen (15) acres of property located within the Woodhaven Village development in the Township of Old Bridge and more fully described in the document known as "Preliminary and Final Subdivision Plat, Woodhaven Village Public Open Space Dedication, Block 22001, Lot 4 and Block 22000, Lot 37, Township of Old Bridge, Middlesex County, New Jersey" dated March 30, 1999 and revised to March 10, 2000 and filed with the Office of the Clerk of Middlesex County on April 14, 2000 as Map No. 6057, File 984. The conveyance of the property shall be made by deed in a form approved by the Township Attorney.

Section 3. Inconsistent Ordinances.

All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency

Section 4. Partial Invalidity.

If any section, paragraph, clause or provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, clause or provision so adjudged and the remainder shall be deemed valid and effective.

Section 5. Effective Date.

A. Except as set forth at subparagraphs B and C hereof, this Ordinance shall take effect on the earlier of the following dates: (1) on the date the Mayor affixes his/her signature thereto and returns same to the Municipal Council by delivering it to the Municipal Clerk pursuant to NJSA 40A:69A-41 or (2) on the tenth day following presentment to the Mayor of the Ordinance pursuant to NJSA 40A:69A-41 applicable when the Mayor has failed to return the Ordinance; whichever occurs first.

B. If the Mayor vetoes the Ordinance (in the manner set forth at NJSA 40A:69A-41), this Ordinance shall become effective upon the Township Council's vote to override the Mayor's veto.

C. The purpose of the Ordinance is to amend section 7-2.B.4 Old Bridge Land Development Ordinance to provide that a residential development under 25 units may be required to have at least two points of access when the Township Engineer determines that two points of access are required in the interest of the health, safety and welfare of the public.

SECTION 2: AMENDMENT

A. Section 7-2.B.4 of Old Bridge Land Development Ordinance is amended as follows:

All uses shall maintain a continuing conformance with the following safety and environmental performance standards. Regardless of any other provisions of this ordinance, deviations from these standards shall establish the otherwise permitted use to which they relate as not permitted. Violations of these standards shall constitute a change in the use of the property and shall be abated in order for legal occupancy of the premises to continue. All uses must hold and comply with all applicable State and/or Federal license permits.

(a) through (m) unchanged.

(n) Each residential development of 25 or more dwelling units shall have two or more points of access. Nothing in this section shall preclude the approving board from requiring a second point of access in developments containing less than 25 residential units if the Township Engineer determines that a second point of access is required in the interest of health, safety and welfare of the public.

SECTION 3: INCONSISTENT ORDINANCES

All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency.

Section 1. Purpose

The purpose of this ordinance is to amend Old Bridge Land Development Ordinance to provide that upon the filing of an application of development, an applicant must post a notice of development application upon the property for which development has been proposed.

Section 2. Ordinance

Section 10-3 of the Old Bridge Land Development Ordinance is amended to include Subsection M which shall read as follows:

M. Posting of Notice of Development Application

Upon the filing of an application for development, applicant shall post a sign upon the property which is the subject of the application. Such signs shall provide notice to the public that the property is the subject of a proposed subdivision, site plan, and/or variance application. The signs shall be obtained by the applicant from the Township of Old Bridge at the expense of the applicant. Signs shall be posted in such a manner so that one sign is clearly visible from all the roadways which abut the subject property. Signs shall be posted within seven days of the filing of the application and shall not be removed until the application is approved, rejected or withdrawn.

Section 3. Inconsistent Ordinances.

All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency

SECTION 1: PURPOSE

President Bush has issued orders calling-up reserve forces in connection with Operation Noble Eagle and Operating Enduring Freedom in response to the recent terrorist attacks against the United States. This Ordinance is enacted to expressly provide extensions of Township pay and benefits and continuation of Township pay and benefits for those Township employees called -up to military duty.

SECTION 2: COMPLIANCE WITH COLLECTIVE BARGAINING

AGREEMENT

Nothing herein shall be construed to constrict or eliminate a right or benefit conferred by any Collective Bargaining Agreement. The Mayor shall issue appropriate regulations of rules to avoid conflict with such agreements if necessary.

SECTION 3: SENIORITY RIGHTS AND BENEFITS OTHER THAN HEALTH COVERAGE

No employee called-up for Operation Noble Eagle and Operation Enduring Freedom shall suffer any loss of seniority or benefits other than health benefits. Health benefits are controlled by Section 5 of this Ordinance.

SECTION 4: SALARY

Employees called-up in Operation Noble Eagle and Operation Enduring Freedom shall be paid differential pay between their Township of Old Bridge gross salary and their military base pay. The Finance Director is hereby granted appropriate discretion to determine the likely military base pay of the employee involved. The Finance Director is also given full discretion to adjust and/or readjust pay upon receipt of information clarifying the actual amount of military base pay being received.

Employees' regular pension contributions contributing group life insurance premiums and/or other payments normally deducted shall be deducted from the payments being made to the employee from the Township of Old Bridge (differential pay).

SECTION 5: INCONSISTENT ORDINANCES

I don't know where the thought that it required an ordinance came from.

If not expressly waived, that coverage will be continued while the employee is on military duty.

George Koehler: You discussed rescinding the storm water basin ordinance. That ordinance was prepared because of numerous complaints and concerns presented to council and the planning board by residents. This was to protect the township from having to take over these basins. If there is a problem with the fund and how it is set up, please, adjust the amount of the fund, don't eliminate the ordinance, it is a vital necessity for the town. Please reconsider this.

President Maher: We will be discussing this in the future.

Mr. Koehler: I thank you for considering the sign ordinance also.

Lucille Panos: What is happening on November 8th with the detention basin ordinance?

President Maher: We will be having a discussion.

Ms. Panos: What happens when there was already an agreement with the township to take over the detention basins. Does that still remain intact?

President Maher: We are finding out that it is not cost effective using the formula that we have had in place. We need to revisit that formula and possibly adjust the formula.

Ms. Panos: The impression was that you were repealing the ordinance.

Mr. Rao: The governor's race is very important on November 6, 2001.

Ms. Estwanick: Where does the council stands on the pumping station that they want to put on Cheesequake Road. Residents of Madison Park were picked up to go see another facility that they had. Has anyone seen it in progress?

Councilman Butler: Transco Pipeline took 6 residents to their facility in Princeton, the people thought that we going to see something that was running but it was shut down. They felt that they made the trip for nothing because they didn't find anything out.

Ms. Estwanick: We wanted to see the noise levels.

Mayor Cannon: I know that their application has been delayed until February or March.

Mr. Pagnotta: Can we do something with the empty building in Vets Park? Maybe a concession stand.

President Maher: Talk to Mr. Badcock.

Seeing no hands President Maher closed the public portion.

Council Comments

Councilman Redmond: There was something in our packet about filming a commercial at the skate park.

Ms. Shepler: This was the first that I heard about it. Ms. Ward brought this to my attention, not one person here has spoken to these people. I think that if they wish to do that, we should charge them a fee.

Councilman Redmond: The contract says...

Ms. Shepler: That is theirs and we would never enter into that, they have to produce liability to the township. The clerk's office has now put a procedure in place.

President Maher: This is not on our agenda so let's not even discuss it.

Councilman Hoff: There was some concerns about the swings at Cliffwood Beach. We need to do something about the playground at Pirates' Cove. Would you ask recreation to go down there.

Councilman Testino: I would like Cedarview Estate hearing to be on November 26th. I would encourage that Mr. Ruggierio to get the punch list addressed or to collect the money so that the township can do the work.

Councilman Butler: They put a traffic light on Perrine Road and Route 9 with a left turn signal. Who do we to talk to get the signal working?

Mayor Cannon: We will call the DOT and find out what the hold up is.

Councilwoman Hegarty: I would like to see the minutes on the detention basin so that we can see the history behind this ordinance.

Councilman Hoff: Are we now in condemnation proceedings on Cedar Ridge II and Lambertson Tract? I thought Lambertson was in negotiations.

Mayor Cannon: I don't think that the papers have been filed yet.

Mr. Condon: I believe that is correct, but I would have to check. I will let Mr. Hoff know tomorrow.

RESOLUTION #505

BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:

WHEREAS, application has been filed for a person to person transfer of Plenary Retail Consumption License #1209-33 -032 -003; heretofore issued to Honingfeld Bradford & Stolar, t/a T.G.I. Friday's for premises located at 1001 U.S. Highway 9 North Old Bridge, New Jersey to BRIAD RESTAURANT GROUP, L.L.C. , t/a T.G.I. FRIDAY'S for premises located a 1001 US Highway 9 North, Old Bridge Township, New Jersey; and

WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term; and

WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations, promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33; and

WHEREAS, the applicant has disclosed and the township authorities have reviewed the source of all funds used in the purchase of the license and the licensed business, and all additional financing obtained in connection with the licensed business; and

WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid and the license has been properly renewed for the current license term;

NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Old Bridge does hereby approve the person-to-person transfer of the aforesaid plenary retail consumption license effective October 22, 2001 and does hereby direct the Township Clerk to endorse the license certificate to the new ownership as follows: "This license, subject to all of its terms and conditions, is hereby transferred to BRIAD RESTAURANT GROUP, L.L.C. effective October 22, 2001 .

BE IT FURTHER RESOLVED that said transfer is hereby conditioned that no go-go dancing be allowed.

Moved by Councilman Hoff, seconded by Councilman Butler and so ordered on the following roll call vote:

AYES: Councilmen Butler, Greene, Hoff, Redmond, Sohor, Testino, Councilwoman Hegarty, President Maher.

NAYS: None.

ABSENT: Councilman Cucchiara.
