OLD BRIDGE TOWNSHIP COUNCIL
January 1, 2002
A Reorganization meeting of the Township Council of the Township of Old Bridge was held on January 1, 2002 in the Municipal Complex. The meeting was called to order by Township Clerk Rose-Marie Saracino, at 12:00 noon.

Councilman Calogera: I want to thank my wife and family for all their help and patience. My friends and neighbors, Debbie Depew and Jeff, Marianne Gurliaccio and Jimmy Galante. I was very lucky to travel when I was younger and I know how fortunate we are to live in a democracy, with people helping run the government. Four years is a long time and I would like to measure the next four years in achievements instead of days and months. I'm here to help all the wards. Thank you and Happy New Year.

Councilman Greene: Two years ago today I was leaving after having lost a close election. Today is a terrific day for me. I would like to thank the Republican party and all my supporters in ward five. The key ingredient to my success is that in ward five I am known as Pat Greene's husband and Richard, Kristen and Erin's father. Thank you all very much.

Councilwoman Panos: I want to thank my friends and family. There are so many things that you did for me. To my colleagues on the council I want to say that I come as a Republican candidate and I am proud of that, there is a Republican tradition in this town; the mayor, Barbara Cannon, elected six times to office. The George Bush Center, the Tom English Building and the Peter Mannino Park, I am in good company here. However, when I sit at the dais my party politics will stay outside the door and I challenge all the others to do the same. I will be accessible and responsive. If it can be said "Well done, thy faithful servant" I will know that I have done my job well. I wish you all a happy new year and God Bless us all.
Township Clerk Rose-Marie Saracino asked all present to participate in a salute to the flag which was followed by a prayer given by Father Joe. President Butler: I want to thank the residents of Old Bridge for being great citizens. I would like to have Jerry (Cucchiara) come forward to be recognized. Running for office is a very difficult process and includes and infringes on family and friends and I would like to thank his family for letting him be involved. I am sorry to lose him, he did a great job and I want to keep him involved. Thank you very much Jerry.
Mr. Cucchiara. I appreciate that and would like to thank Mr. Butler for those kind words.
President Butler: I want Roman (Sohor) to come and be recognized also, since I am an equal opportunity employer. I worked with Roman for quite a long time and on a lot of projects. You can have a difference of opinion with someone, but that does not mean that you fall out of love with someone. Roman & I did the best that we could together to do the best for the taxpayers. Roman worked hard over the years for the residents and I want to thank you for all your time and hard work and I hope that you stay involved.
Mr. Sohor: Thank you Reggie for your kind words and it was a pleasure working with you. Congratulations on becoming the President of the Council, you deserve it and I wish you the best of luck and success in your term.
President Butler: I want to thank my colleagues for making me president and I am looking forward to working with all of you. When we sit up here, we are not Democrats and Republicans, we are representing the residents of the Township of Old Bridge. We have to make sure that our solutions solve the problems of the people. I am going to change something, I don't think that it should be business as usual, when someone comes before us with a problem, I don't think that we should just say thank you, I think that the individual council person should go down and talk to those people and follow up and go to all lengths to get the problem solved. You are the public and we are your representatives and there is something called respect. I am one of eleven children and our parents taught us respect and you have to give respect to get it. I give everyone respect and it always comes back in big numbers. Thank you very much.

Councilman Redmond: I would like to thank my family for their support. I look forward to putting the previous year behind us and going forward in 2002. I want to thank my fellow council members for electing me to this position. I want to also thank the residents of Old Bridge. I would ask that we keep the families of the tragedy of September 11th in our hearts. Let's hope that we make the residents of Old Bridge proud as a council.

RESOLUTION #04-02
BOND COUNSEL
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:
WHEREAS, the Local Public Contracts Law, N.J.S.A. 40:11-5(1)(a)( I) requires the public advertisement of notice with respect to contracts for professional services awarded without competitive bids; and
WHEREAS, funds are or will be available for this purpose;
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, in the County of Middlesex, New Jersey, as follows:
1. That the Township Council hereby appoints the firm of Parker McKay & Crisculo, Attorneys at Law to serve as Bond Counsel to the Township and awards the contract which is awarded hereto and made part hereof (the "Contract"), in accordance with N.J.S.A. 40A:2-38.1 and N.J.S.A. 40A:11-1 et. seq.
2. That the Mayor or other appropriate official of the Township, on behalf of the Township is hereby authorized and directed to execute the Contract, and the Clerk of the Township is hereby authorized and directed to attest to the execution of said Contract for Professional Services in connection with the preparation of all bond ordinances and the authorization and issuance of all bonds, bond anticipation notes, tax anticipation notes or similar obligations and related matter of capital and debt financing by the Township.
3. That no appropriation of funds is required at this time, payment coming from the proceeds of the sale of bonds, bond anticipation notes and tax anticipation notes or similar obligations or from capital authorizations or other appropriate budgeted items in accordance with the attached Contract.
4. That this Contract is awarded without competitive bidding as a Professional Service under the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)( I) because legal services are a recognized profession licensed and regulated by law.
5. That a notice in accordance with this resolution and the Local Public Contracts Law of New Jersey, shall be published in the official newspaper or newspapers of the Township.
6. That an executed copy of the Contract between the Township and Parker McKay & Crisculo and a copy of this resolution shall be filed in the office of the Clerk be available there for public inspection in accordance with law.
7. That this resolution shall take effect immediately.

Councilman Baker: I would like move a resolution to expand the recreation committee from thirteen members to fifteen members.
Clerk Saracino: It needs to be done as an ordinance, if this is for regular members.
Attorney Ruggierio: The ordinance does not permit the expansion. You have to introduce an ordinance at the next meeting.
Councilman Testino: Lets put it on for the first meeting.
Councilman Greene: In the interest of bi-partisanship I would ask that you appoint Robert Pepe today. We add two additional members after the ordinance.
Subsequent to the vote the following discussion was made.
Councilman Calogera: I would like to abstain from Nancy Calogera's appointment, since she is related to me.
Councilman Testino: It is a non paying position, you can vote for her.
Councilman Baker: I would like to move a resolution that we expand the council liaison to the recreation board.
Attorney Ruggierio: If you are merely creating a liaison that does not have voting rights you can do that.

RESOLUTION #27-02
ESTABLISHING INTEREST RATE ON DELINQUENT TAXES
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:
WHEREAS, R.S. 54:4-67 permits the governing body of each municipality to fix the rate of interest to be charged for nonpayment of taxes or assessments subject to any abatement or discount for the late payment of taxes as provided by law;
WHEREAS, RS 54:4-67 permits the governing body of each municipality to fix the rate of interest for the nonpayment of other municipal liens and solid waste utility charges; and
WHEREAS, RS 54:4-67 has been amended to permit the fixing of said rate of 8% per annum on the first $1,500.00 of the delinquency and 18% per annum on any amount in excess of $1,500.00
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, as follows:
1. The Tax Collector is hereby authorized and directed to charge 8% per annum on the first $1,500.00 of taxes becoming delinquent after due date and 18% per annum on any amount of taxes in excess of $1,500.00 becoming delinquent after due date, subject to any abatement or discount for the late payment of taxes as provided by law.
2. The Utility Revenue Collector is hereby authorized and directed to charge 8% per annum on solid waste utility charges becoming delinquent after due date.
3. No interest shall be charged if payment of any quarterly tax payment is made within ten (10) days of the date upon the same becomes payable.
4. In connection with any delinquency of taxes, assessments or municipal charges in excess of $10,000 which has not been paid prior to the end of a fiscal year, there shall be imposed a penalty in the sum equal to six (6%) percent of the delinquency in excess of $10,000.
5. With respect to tax certificates held by the municipality in excess of the sum of $200, the following additional penalties shall be charged: two (2%) percent on the amount due over $200 up to $5,000; four (4%) percent of the amount due over $5,000 up to $10,000; and six (6%) percent on the amount in excess of $10,000.
6. Any payments not made in accordance with paragraph two of this resolution shall be charged interest from the due date, as set forth in paragraph one of this resolution.

Mayor Cannon: I would like to welcome the new council members and congratulate the returning members. I am sure that the year 2002 will be a better year than 2001 in terms of what happened to this country. I think that the tragedy of September 11th has made us all prioritize and realize what is really important to us. MAYORAL APPTS/COUNCIL CONCURRENCE
Mayor Cannon: I am expanding the Library board by two members, I have been told from the attorney that the Library Board can consist of either seven or nine members and that our ordinance does not indicate the number of members. Because we have big plans going forward with the library and a lot of interest, I want to reappoint Dr. Robert Lipp and add Joe Nuzzo and Roman Sohor.
Councilman Testino: I would like to see the ordinance amended to reflect the right number, so that we don't have a problem in the future.
Councilman Hoff: I would like to ask the attorney if the council can have some oversight on the Library Board? In the last year the council was brought into; after the fact, large costs that were absorbed by the Library Committee. It happened to us three different times, we had to pay for things that we had no knowledge of what was going on. We had a memo given to us by the library in November that they had since May 7th regarding a major problem.
Attorney Ruggierio: The free library board is a statutory board that has autonomy over library property and operations, so depending on what you mean on "oversight" the answer is; No. Council just like any citizens has a right to know what a public body does and in that sense you can have oversight. You can be aware of what is going on, so that you can intervene because you have a very big role at budget time, certainly you can receive their minutes, attend their meetings and you can organize your council in such a way that you can have some special attention to library matters; like a council subcommittee. You cannot have an impact on their operations, they have autonomy over their operations.
Councilman Testino: I would ask that we form a committee to at least investigate the $250,000.00 expenditure for the electricity. The committee should also make sure to stay on top of repairs to the building, which is certainly the business of the council.
Councilman Hoff: I don't want to know about the day to day operations, but I do want to know about the substantial expenses over budget. After the budget was done, they came to us for requests for extraordinary repairs, one was $250,000.00. We need to have input before the fact, not after.
Mayor Cannon: I have notified the council that I have set up an committee and it is working on what happened to the electricity. We all want to know what happened there. I understand that the library minutes are distributed to council on a regular basis. The meetings are public and anyone can come and comment. I think that this board is excellent and we have a new director who is looking forward to moving the library along. I would like your advice and consent on the membership so that we can begin as a full board. =
Councilman Hoff: We do not have access to what goes on. We got a memo in November that was dated May 7th. That is not being kept informed, some one should of told us about this long before November. There were three problems during this year.
Mayor Cannon: I think that we should get on with the business of the day, which is completing the appointment process.
Councilman Redmond: I agree with the idea of the committee...
Councilman Testino: The council president can appoint the committee today.
Councilman Hoff: I move to table the Library appointments.
Mayor Cannon: We will not have a full board... Thank you council.
President Butler: I will appoint Joe Hoff, Richard Greene, Larry Redmond and Ed Testino to the library committee.
Mayor Cannon: I think that the attorney has to lay out very carefully what their role is.
Councilman Testino: Larry wants to serve.
Councilwoman Panos: I would like to serve also.
President Butler: You cannot have five members.
Councilman Maher: What are the terms of the two additional members?
Mayor Cannon: I believe that they are three year appointments.
Clerk Saracino: I think they are five year appointments.
Mayor Cannon: No, that is the planning board.
