A Combined Meeting of the Township Council of the Township of Old Bridge was held on June 10, 2002 in the Municipal Complex. The meeting was called to order at 7:40: p.m. by Vice President Redmond.
Deputy Clerk, Stella Ward, announced that pursuant to Section 5 of the Open Public Meetings Act, this meeting has been advertised in the Home News and Tribune and that the next public meeting would be held on Monday, June 17, 2002 at 8:00 p.m. at the Rotary Senior Housing, 100 Ticetown Road, Old Bridge.

Report of the Attorney.
Attorney Ruggierio: On May 29 we completed the hearing on the Woodland Trails condemnation matter before the commissioners. The transcripts will be produced, and we will be submitting written closing arguments. Within the next twenty to thirty days, we will have a decision.

Prior to the roll call vote the following discussion took place.
Councilman Redmond: We have been receiving memos from the attorney's office with respect to the Hovnanian settlement. Are we getting a summary of what that means? I have been reading the settlement in legal terms. I was on the planning board through some of it, but there are council members who were not, and they need to be brought up to speed.
Attorney Ruggierio: I would be happy if council wants to set aside a few minutes at the next agenda meeting so that I can give an overview. I scheduled a request that we would be able to go over the pending settlement with the Sommers people. I ask that we have a meeting to which I would bring Messrs. Carney and Howarth, who are handling the insurance defense section of this to give the council an overview. We have three meetings a month on this with draft documents. I would not want to get to the end to find out that some of you had other ideas. We are going to ask that this be brought before the council soon.
Preliminary public comments.
Mr. Seewald: Requested the state legislators introduce a bill changing the legislation with respect to the date for the school election which is currently held in April. Asked the council for a non-binding resolution on the same issue.
Guest - Michael Caffrey - Open Space Committee.
Mr. Caffrey (chairman Open Space Committee): I have been invited here to let you know what has been going on with respect to our recommendation for the Middlesex County Open Space Trust Fund. On April 10th the committee was advised by the Mayor that the county was seeking some recommendations for parcels that the township would acquire from the county open space trust fund and parcels that the county would directly acquire. At that meeting we agreed that we would recommend a series of parcels, but that we would not yet prioritize with the parcels we thought should be first, etc.
The parcels identified were the Cheesequake Little League complex, the Cheesequake Farm, Sayrewoods South Rebel Football Association and Old Bridge Little League complex and several parcels in and around the Cedar Ridge II parcel which we term "Cedar Ridge Out Parcel". Those are which we believe the township should acquire with the assistance of the county open space trust fund. We also recommended certain parcels that the county itself would acquire, i.e., Nike and Safron Tracts adjacent to the Runyon Watershed, Madison Park Little League, and Raritan Bay Cougars Football Association complex and several out parcels around the Phillips Preserve. We met on May 8 to prioritize this list, and here are our recommendations to the Mayor and the council.
The parcels for acquisition by the Township of Old Bridge with the assistance of Middlesex Open Space Trust Fund are in order of priority:
1. Cheesequake Little League Complex 2. Madison Park Little League and Raritan Bay Cougar Association 3. Cheesequake Farm 4. Madison Farmer's Tract (between Cheesequake Farm and Lambertson tract) 5. Cedar Ridge out parcels
We also recommended that the county acquire the following three parcels in order of priority:
1 Sayrewoods South Rebels Association and Old Bridge Little League Complex 2. Nike and Runyon tract (the first part being the old Nike base and the second part being a tract owned by Mr. Safron 3. Phillips Preserve out parcel.
Councilman Redmond: The Open Space Committee worked diligently on putting this list together.
Councilman Testino: I would like to adopt the recommendation in paragraphs 3 and 4 in toto as the list that will be sent forward to the county with the governing body stamp of approval and annex a copy of the open space committee's resolution to show that we have the full support of that committee. As a part of that motion I ask that the Clerk send that out immediately because the county is starting to put in order their thoughts on these land acquisitions.
Resolution No. 266
RECOMMENDING PARCELS IN THE TOWNSHIP OF OLD BRIDGE FOR ACQUISITION BY MIDDLESEX COUNTY AND BY THE TOWNSHIP IN COOPERATION WITH THE MIDDLESEX COUNTY OPEN SPACE TRUST FUND
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:
WHEREAS, the Township of Old Bridge Open Space Committee on June 5, 2002 recommended for acquisition certain parcels in the Township of Old Bridge by Middlesex County and by the Township with the assistance of the Middlesex County Open Space Trust Fund; and
WHEREAS, the Township of Old Bridge hereby endorses the recommendation of the Open Space Committee;
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, that the following parcels are recommended for acquisition by the Township of Old Bridge with the assistance of the Middlesex County Open Space Trust Fund:
- Cheesequake Little League Complex. Block 10258, Lot 12 (56.68 acres). Property owned by Brunetti.
- Madison Park Little League and Raritan Bay Cougar Football Association. Complexes. Block 5001, Lot 13 (135.16 acres) . Property owned by Manzo.
- Cheesequake Farm. Block 10252, Lots 10, 26.12 (93.27 acres + 27.18 acres. Property owned by Brunetti.
BE IT FURTHER RESOLVED, that the following parcels are recommended for acquisition by Middlesex County:
- Sayrewoods South Rebels Football Association and Old Bridge Little League Complexes. Block 8003, Lot 21 (101.97 acres). Property owned by the City of Perth Amboy..
- Nike and Runyon tracts: Old Nike Base - Block 7000, Lots 4.15, 4.12 (35.44 acres + 15.02 acres); Safran Tracts - Block 7000, Lot 3.11 (70 acres) and Block 6303, Lot 7 (116.55 acres).
- Phillips Preserve out parcels
BE IT FURTHER RESOLVED, that the Township of Old Bridge hereby formally requests Middlesex County to consider providing funding for the construction of a YMCA facility within the Township of Old Bridge.

Councilman Maher: I would like to amend the resolution. It has been brought to my attention that the letter to Middlesex County to municipal officials not only asked for monies for open space, but any other township improvements. I would like to add a paragraph with respect township improvements to see if there is any money available to assist us in the YMCA.
Councilman Testino: I accept that as a friendly amendment.

Mr. Sumal: This bond includes work on the extension to the existing building which has been completed. The work has been completed and inspected as satisfactory. There is a $3,346.84 performance bond. The cash portion is $9,260.76.

Ordinance No. 24-02 TABLED
Vacating a Portion of Disbrow Road
WHEREAS a portion of the Disbrow Road right of way is no longer needed for use as a public roadway as a result of realignment.
NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey as follows:
Section 1. Purpose
The purpose of this ordinance is to vacate an unimproved portion of the Disbrow Road right of way which is no longer needed for public use by the Township of Old Bridge.
Section 2. Ordinance
The Township of Old Bridge hereby vacates a portion of Disbrow Road near the intersection of Disbrow Road and Amboy Road and more fully described in the document entitled "Scheduled A" on file with the Township Clerk. The Township of Old Bridge expressly reserves all rights and privileges now possessed by public or private utilities to maintain, repair and replace their existing facilities in, adjacent to, over or under the roadway being vacated including, but not limited to, gas, water, cable, telephone, electric, sanitary sewers, and any appurtenances and rights of ingress or egress relating thereto.
Within sixty (60) days of the effective date of this ordinance, a certified copy of this ordinance together with proof of publication shall be filed with he Clerk of Middlesex County for recording.
Section 3. Inconsistent Ordinances
All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency.
Section 4. Partial Invalidity
If any section, paragraph, clause or provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, clause or provision so adjudged and the remainder shall be deemed valid and effective.
Section 5. Effective Date
A. Except as set forth at subparagraphs B and C hereof, this Ordinance shall take effect on the earlier of the following dates: (1) on the date the Mayor affixes his/her signature thereto and returns same to the Municipal Council by delivering it to the Municipal Clerk pursuant to NJSA 40A:69A-41 or (2) on the tenth day following presentment to the Mayor of the Ordinance pursuant to NJSA 40A:69A-41 applicable when the Mayor has failed to return the Ordinance; whichever occurs first.
B. If the Mayor vetoes the Ordinance (in the manner set forth at NJSA 40A:69A-41), this Ordinance shall become effective upon the Township Council's vote to override the Mayor's veto.
C. Notwithstanding any other provision hereof, this Ordinance shall not take effect less than twenty (20) days after its final passage by the Council and approval by the Mayor, where such approval is required, unless the Council shall have also adopted a resolution declaring an emergency and at least two-thirds (2/3) of all the members of the Council vote in favor of such resolution.

Councilman Testino: I had asked the attorney to check the description to be sure that we are not vacating the portion of the road that goes into Knoll Court.
Attorney Ruggierio: Mr. Testino raised a question about the description, and I sent it to engineering.
Councilman Testino: I request that we hold this until my question has been answered. I don't want a mistake about vacating what we are using as the road.
Attorney Ruggierio: Mr. Vincenti needs to comment on this.

TOWNSHIP OF OLD BRIDGE ORDINANCE NO. 25-02
ORDINANCE ESTABLISHING FEE FOR INTERNET PAYMENT
BE IT ORDAINED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey as follows:
SECTION 1: PURPOSE
This ordinance establishes a fee amount for the payment of property taxes through the Internet.
SECTION 2: ORDINANCE
A fee of one ($1.00) per transaction shall be charged for Internet payment of property taxes.
SECTION 3. INCONSISTENT ORDINANCES
All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency.
SECTION 4. PARTIAL INVALIDITY

AN ORDINANCE ESTABLISHING SPEED LIMITS FOR MORRISTOWN ROAD/LAURENCE HARBOR ROAD (AKA MATAWAN ROAD/LAURENCE PARKWAY
BE IT ORDAINED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, as follows:
SECTION 1: PURPOSE
This Ordinance shall establish speed limits for Morristown Road/Laurence Harbor Road (aka Matawan Road/Laurence Parkway in accordance with the recommendations of the Middlesex County Engineer.
SECTION 2: SPEED LIMITS
- Chapter X of the Code of the Township of Old Bridge is hereby amended by adding and supplementing Schedule IX thereof (incorporated by reference in Code Section 10-9) with the following:
The speed limit for both directions of travel on Morristown Road/Laurence Harbor Road (AKA) Matawan Road/Laurence Parkway shall be as follows:
Zone 1 - 30 m.p.h. from the southerly Old Bridge Township line to Cliffwood Avenue Zone 2 - 40 m.p.h. from Cliffwood Avenue to Lea Avenue Zone 3 - 35 m.p.h. from Lea Avenue to State Highway 35
SECTION 3: INCONSISTENT ORDINANCES
All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency.
SECTION 4: PARTIAL INVALIDITY

Section 1. The Township Council hereby declares a certain municipal right of way known as the portion of Spring Valley Road, defined by the following metes and bounds description, vacated.
Beginning at a point, said point being the intersection of the easterly right-of-way (ROW) Line of Marlboro Road (variable width R.O.W. with the northerly R.O.W. line of Spring Valley Road (33 feet wide R.O.W.), said point also being the southwest corner of Block 21005, Lot 2 and running:

WHEREAS, Rolling Meadows Subdivision comprises 26 single family homes located off Ferry Road next to Kindercare. All certificates of occupancy have been issued and the houses are occupied. There is no homeowners association; and
WHEREAS, there is one detention basin in this development and the developer has made a payment for the transfer of the detention basin to the Township. All roads in this development are to be public roads; and
WHEREAS, a bond hearing was held on May 13, 2002, at which time the Township Engineering Department and the Township Council were heard; and
WHEREAS, the original Performance Guarantee ($832,869.30) was reduced once in March, 2000, by 35% of the following amount:
Performance Bond $487,228.54
10% Cash Deposit $54,136.50
Total $541,365.04
WHEREAS, the Township Engineer has performed an inspection of the site and has found that the bonded items have been completed satisfactorily. However, the yard area on Lots 11 and 18, Block 17009 were recently re-graded and seeded. The developer has agreed to allow $5,000.00 to be held in escrow to guarantee these improvements; and
WHEREAS, the Township Engineer has recommended a release of the Performance Guarantee.
NOW THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey that the performance guarantee be released subject to the developer posting a Maintenance Bond in the amount of $124,930.00 (15% of the Original Performance Bond) and;

WHEREAS, the Township Council wishes to authorize a contract with T&M Associates for purposed of providing the aforesaid drainage study at the Sayrewoods South Little League Field.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, as follows:
1. A contract for professional services is authorized to be entered into with T&M Associates in an amount not to exceed $16,800.00
2. The award of the contract is contingent upon the issuance of a Certification of Availability of Funds No. 1048 certifying the existence of a sufficient appropriation to fund the said contract.

WHEREAS, permission is hereby granted to St. Ambrose to hold their annual Carnival from June 18, 2002 through June 22, 2002; and
WHEREAS, the Township's portion of permit fees and related fees in the amount of $100.00 for the St. Ambrose Carnival to be held from June 18, 2002 through June 22, 2002 are hereby waived; and
WHEREAS, the Township Council cannot waive the State's portion of the fees and they shall be paid.

WHEREAS, the South Old Bridge Volunteer Fire Company has requested that the said fees be waived; and

Ms. Shepler: This is an application at the planning board level which was heard, but the applicant never submitted the fees. To recoup the fees, we place a municipal lien on the property. "Leader of the Pack" was the name on the application.

Ms. Cyr: The roof and the electrical situation are being repaired. It is important for the health of the electrical system that the roof be repaired. The specifications for the project are being worked on in administration. The contract is for oversight of the construction during the repair. Cummins & Co. has been working and evaluating the roof for the duration of its problems for many years.
13. Awarding professional services agreement in the amount of $16,500 to CME Associates for the conceptual design of a YMCA Community Center.

AUTHORIZING WAIVER OF FEES FOR GREEN & WHITE FIRST AID SQUAD
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:
WHEREAS, the Green and White First Aid Squad has entered into a contract for the purpose of expanding and updating their building on Ticetown Road; and
WHEREAS, the Green and White First Aid Squad is submitting a request that the building permit fees in the amount of $780.00 and the engineering inspection fees in the amount of $749.85 for a total of $1529.85 be waived; and
WHEREAS, the Green and White First Aid Squad is a nonprofit organization.
NOW, THEREFORE BE IT RESOLVED, by the Township Council of the Township of Old Bridge, Middlesex County, State of New Jersey that the permit fees in the amount of $1529.84 are hereby waived; and
NOW, BE IT FURTHER RESOLVED, by the Township Council that the State's portion of such fees shall be paid.

BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:
WHEREAS, a group life insurance is provided for members of the Public Employees Retirement System (PERS) effective January 1, 1956 by act of the State Legislature; and
WHEREAS, both noncontributory and contributory benefits are made available to employees who meet the eligibility requirements; and
WHEREAS, when a member is granted an official leave of absence without pay, the noncontributory and contributory insurance will continue for up to two years while on leave due to illness provided the public employer approves the leave by formal action; and
WHEREAS, at the end of the two year period of time, the member is permitted to convert the policy to an individual policy.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey that David McAndrew, Township employee, has formally requested leave of absence without pay resulting from a personal illness.
BE IT FURTHER RESOLVED, that the leave of absence will become effective as of May 31, 2002 and notification of said leave will be provided to the Division of Pensions by Marsha Rosenbaum, Director of Human Resources, and a copy of this resolution shall also be provided to David McAndrew.
BE IT FURTHER RESOLVED, that the leave of absence of David McAndrew is formally recognized, having been heretofore authorized by the Mayor, and it is understood that the Mayor may terminate the said leave of absence recognized under this resolution at any time and/or for any reason.

GRANTING PERMISSION FOR A BLOCK PARTY CALVIN COURT
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that:
WHEREAS, the residents of have requested permission to close Calvin Court (Hyatt & Hastings Intersection) for the purpose of a block party to be held on June 22, 2002 (June 23 2002 Rain Date)
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that permission is hereby granted to hold said block party contingent upon the following conditions.
It is a requirement of this approval that you must submit a sign-off sheet of approval from all residents affected in this closing. This list must be delivered to the Clerk's office before Council approval.
It is a requirement of this approval that Calvin Court be completely closed to vehicular traffic. This closing must apply also to the residents' vehicles as well as other vehicles. You will be responsible for making provision to have the roadway blocked, making sure that there is access for residents to enter and depart as they desire. It is also a requirement of this approval that a 12 foot clearance be maintained on each side of the fire hydrant and that amusement games are prohibited from being set up on the side of the street having the fire hydrant (food tables may be set up on the side of the street having a hydrant).
The party must end and the streets reopened to traffic and completely cleared of people, paraphernalia and debris by 10:00 p.m.

AUTHORIZING SFY 2002 BUDGET TRANSFER $535,22500 - GENERAL ACCOUNT AND $17,500.00 - ARENA UTILITY ACCOUNT
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that
WHEREAS, it has become necessary to expend for various purposes which are specified in the budget, and amount in excess of the respective sums appropriated therefore; and
WHEREAS, there is an excess in certain other appropriations which are specified in the budget which are legally available for transfer; and
WHEREAS, under the provisions of R.S. 40A:4-58, during the last two months of the fiscal year, the Governing Body has the authority to transfer the amount of such appropriations as may be deemed to be in excess to such appropriations as may require it.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Old Bridge Township that the transfer in the amount of $535,225, be made between the Current SFY 2002 Budget and the $17,500 between the Arena Utility Account as follows:
