AGENDA MEETING
June 16, 2003
An Agenda meeting of the Township Council of the Township of Old Bridge was held on June 16, 2003 in the Rotary Senior Housing Building, 100 Ticetown Road, Old Bridge. The meeting was called to order by President Butler who asked all present to participate in a salute to the flag which was followed by a short prayer.
Deputy Clerk Stella Ward announced that this meeting is being held in conformance with the open public meetings act, notice has been given to the newspaper and notice of the meeting has been posted in public places. The next meeting will be June 23, 2003 at 8:00 p.m.
Roll call at 7:40 p.m. by Deputy Clerk Stella Ward, showed the following members present: Councilmen Baker, Calogera, Greene, Hoff, Maher, Redmond, Councilwoman Panos, President Butler. Councilman Testino arrived late.
President Butler: I would like to start out by listening to the members of the public before we start the official meeting.
President Butler opens the meeting for public comments.
Woman Resident: Is the 10:00 a.m. bus from here to the township going to be re-instated?
Mayor Cannon: We will check into it and see why the schedule was changed.
Barbara Mazarus: We are opposed to the visiting nurses program legislation that is being proposed in Trenton and we would like the council's help on this.
President Butler: We have just received this paperwork tonight. We would like to review it and get back to it later in the meeting.
Thomas Frangipani: We heard that the building was sold, is this true?
Councilman Redmond: As far as I know, and as early as yesterday, I spoke with Harry Gelder of the Rotary and he assured me that the building was not sold. Unless this has changed in the last 48 hours, I am not aware of it.
Mr. Frangipani: We were told by the administration of this building that it was definitely sold.
Female Resident: We were told that a silent partner took over and it was sold.
Councilman Redmond: I was assured by members of the Rotary that this was not the case.
Female Resident: How will we find out for sure?
Councilman Redmond: When Mr. Testino arrives, he may have that information, if not we will follow up on it, first thing tomorrow. If you leave your name with the clerk or administration we will get back to you.
Mr. Frangipani: Why does the cable company keep changing the local channel, it has been changed a number of times already?
Attorney Ruggierio: We have expressed our disappointment with these changes in the newest settlement and unfortunately, we don't have any control over the channels. The BPU and the Federal government allow them to flip around the channels. We were able to stop being put into the upper channels because apparently the sound was awful. We have gotten assurances from Cablevision that they are not looking to make dramatic changes in the channels in the future.
Mr. Frangipani: Is there another company that can take over?
Attorney Ruggierio: It is very expensive for other cable companies to come in and compete because of the cables and line. The only other competition right now is satellite TV.
Female Resident: They took away the channels that we like and gave us channels we cannot understand and also charged us more money. It is not fair.
Attorney Ruggierio: Federal law requires that they carry these channels and we cannot tell them not to.

Councilman Redmond: Other towns are getting involved to lower the cost of prescription drugs for seniors.
Councilman Calogera: This will be on the agenda for Monday, the seniors can watch the meeting or come to the meeting so that you will get more in-depth information. There will be a guest speaker on this subject.
G-2 T & M Associates - Re: Mannino Park Master Plan.
Councilman Maher: I've seen a copy of the draft of the master plan and I think that T&M has done an outstanding job. I am confident that it can accommodate the YMCA.
Mr. Badcock: This is a large park and there will be parking for almost a thousand cars, all the fields will be lighted, which is good because the closest resident is about 3,000 feet away and it is highly buffered by a high degree of woods and it will line up with the entrance at Owens Road, we are looking to purchase an acre and a third of the property from Perth Amboy to provide safe access in and out of this park. This is a possible site for the YMCA, they are hoping that we can fund raise enough money to develop a 50,000 square foot YMCA, which there is enough room for on this property and there is also enough room to expand that to a 100,000 square foot facility which could accommodate up to 14,000 memberships. I think that our planning for the future is secure with this park.
Councilman Hoff: How much is of this is wetlands and how much it uplands?
Mr. Badcock: The total site is 165 acres in the park and the engineers, which was confirmed by the NJDEP in the field that there is 111 build-able acres.
Councilman Maher: The YMCA is for residents of all ages, we are looking to build a 25-meter indoor pool and therapeutic center, there will be meeting rooms and programs for senior citizens and age restricted people. The YMCA has just completed their marketing study and I want to highlight some bullet points that are encouraging; The YMCA has projected an estimate of 4,400 families that are likely to join the YMCA and they are considering that to be conservative and that 4,400 is just Old Bridge residents. If you factor in neighboring communities that number grows to 6,800 families. They also concluded that 7% of the households were willing to volunteer for a capital campaign and out of those they reached a $60.00 per month, or $720.00 a year to join the YMCA. The study also indicated that the new Old Bridge Y would within two years have the same level of membership as the current Y in Red Bank, and that is who is sponsoring this YMCA. This was very encouraging. The concurs with our own web based study and we are very encouraged about bringing an Old Bridge YMCA to town. I would like to move and vote on a resolution this evening that Mannino Park be the potential site for the Old Bridge YMCA.
Councilman Calogera: I will second that.
Councilman Maher: We don’t know the final cost for the infrastructure improvements and at a later date it might be cost prohibitive, but right now I think that Mannino Park is the prime location for the YMCA.
Councilman Greene: I would like to thank Councilman Maher for joining my plea that I made about a month ago in asking that Mannino Park be selected for the Y site. There were discussions about squeezing the facility in Town Center. I am glad that my colleagues have now seen the light, they are putting forward a resolution to put the YMCA in Mannino Park. This is a very ambitious endeavor and will be expensive because what is there now is just a wooded area, we need a road, water, sewer and we will need financial resources to help construct the Y and as Mr. Maher as said there will be fundraising, but we will need financial support for all the recreational facilities that will go in that park. So what I would like is for this council to ask the county to financially support the infrastructure as well as construction of the recreational facilities that will go in Mannino Park. The average taxpayer in Old Bridge, with a house assessed at $150,000.00 pays 987.00 in Municipal taxes and another $681.00 in County taxes. Where do our county taxes go? Let’s get the county to support some of Old Bridge’s recreational programs in Mannino Park.
Councilman Calogera: I have always been for the Mannino Park site and I am glad that the rest of the council is leaning that way. I want to thank Mr. Maher and the members of the YMCA committee. This is a project that is a win win for everyone. I would love to be able to get money from the county, state and federal governments. The more money that we can get the better for us.
Mayor Cannon: I would like to also commend the council for moving forward on this project, we have been working on this for many years and we were very fortunate to take possession of Mannino Park which will accommodate this facility and as Tom Badcock mentioned for future growth of the facility. I think that the really good thing about this is that, other then the actual building itself, the money will not come out of Old Bridge tax dollars. We are looking for contributions from the county and state. The fund-raising is going to be actively done by the Y, who are professional fund raisers. They will start the process early in the fall.
Councilman Maher: I feel a need to address Councilman Greene’s remarks with respect to finally jumping on the band wagon. I have been chairing the YMCA committee for 12 months and there was no need to rush to this decision for the site. We have put together a time line and moved cautiously and deliberately. No one has asked us to rush to a selection of a site, no one from the YMCA has pushed for a site, this council has not requested that we move faster. Now that the draft master plan has been finalized, now is the time to move forward. I do take exception to Mr. Greene saying that we have finally jumped on the band wagon. I think that Mr.
Greene is jumping on the band wagon, thirty days ago he was trying to move this thing forward.
Councilman Redmond: If you look at the last request that we sent to the county when they were doing their recreational assessments, this council approved a request for just this project. We talked about an aquatic center, so there is already a request that the county is evaluating. I support requesting money from other agencies, I just wanted to mention that there has already been a request and I would certainly support any further requests for help.
Councilman Hoff: I have no problem with the selection of the site of Mannino Park. What bothers me is that we have a report from T&M that is scheduled for Monday, why are we discussing this tonight. I know that some of you have seen the rough draft that T&M has prepared, but most of us haven’t. Can’t we have a chance to look at the plan before you ask us to vote?
Councilman Greene: I will support Mr. Hoff’s position and will make a motion to table this.

Councilman Greene: I do not have a resolution in front of me and I thought that the council’s position was that we do not vote on resolutions unless they are prepared in writing and in front of us.
Councilman Maher: Bill, will you draft a resolution before the end of the meeting?
Attorney Ruggierio: Yes.
Councilman Greene: I would like to make a motion that the county financially support the recreational facilities that are going to be included in Mannino Park.
Councilwoman Panos: I will second that.
President Butler: We don’t have a resolution for this.
Councilman Greene: I would ask the attorney to prepare that one as well.

Councilman Calogera: Are we being provided a list of all the violations and case numbers that are pertinent to these liquor licenses? I want us to be informed about the violations.
Clerk Saracino: I have attached everything that we have received from the state to the resolutions.
Councilman Calogera: Will the local case numbers from our police department be included?
Clerk Saracino: The police department gave us a report that they have no problems with renewing any of the licenses.
Councilman Calogera: I have a problem. I filed a case number under NJ Wines & Spirits, which that case number if 11647-3. I would like that to be in the jacket of this license and I would like it forwarded to me along with anything else in that jacket.
Clerk Saracino: We can request that.
Councilwoman Panos: I know that it has been cited for over the capacity limit, I would like to see the reports from the fire department also. I also would like to see all the complaints that we have received from residents about the Breakfast Club.
Clerk Saracino: I will request that.
Councilman Calogera: We are supposed to act on these licenses and I don’t understand why we aren’t furnished with this information automatically.
Clerk Saracino: Unless it is a specific request , I am not provided with that information automatically. I am not given that information from the police or fire departments.
Councilman Calogera: How can we make an informed decision if we don’t have all the information?
Clerk Saracino: At the hearing, you have a right to pose questions to his counsel and also ask for whatever reports you want.
Councilman Calogera: I will bring this up at a later date by way of resolution; that all information from all departments on liquor licenses should be forwarded to the clerk.
Councilman Redmond: I would like a report of the numbers and natures of police incidents at Sideline Lounge, TMJ and Breakfast Club.
Clerk Saracino: Unless I receive the tax clearance certificate for Sideline Lounge, I don’t think that you will be able to hear that one.
Councilwoman Panos: I would like to see all the reports on all the establishments to see what goes on. I know that I have read about some of these places in the newspapers about arrests and such.
Clerk Saracino: That request will have to be made to the Mayor/Administration.
Councilwoman Panos: I will make that request of the mayor that we get every report where there is a mark on these places from building, fire and police.
Business Administrator Shepler: Not all of these fall within the jurisdiction of the Township of Old Bridge, there could be building reports that deal with the soffits outside. Occupancy reports would only be generated by the fire department if they were called out by the police. I need more specifics about the building violations that you are looking for, I don’t believe that you could deny a license for a trip and fall. I could not possibly give you all the building reports before next week. I have received e-mail about the Breakfast Club that I may be able to get together before next meeting.
Councilman Redmond: The ones that I am looking for is the Breakfast Club parking situation and occupancy. Sideline Lounge, TMJ t/a After Dark. I would like to know if someone has been stabbed or shot in the parking lot.
Ms. Shepler: I will make the request and have it go through the clerk’s office. Are you looking for over occupancy reports, because that I will have to ask Mr. Gerity and Mr. Diaz for?
Councilman Redmond: Yes.
Councilwoman Panos: I have also read about these places, there was someone arrested with a gun. I want Country Thyme – I want Keg & Cork , I would like to know who the principles are; who owns these places? I would add to the three hearings – Country Thyme and Keg & Cork.
Councilman Calogera: How do I go about having this information directed to the clerk’s office to be put in these liquor jackets, so that we are aware of this at renewal time.
Ms. Shepler: I will ask the police department to make sure the Rose-Marie is copied on every single incident that occurs at any licensed premises.
Councilman Calogera: Is there a reason why this has not been done so far?
Mayor Cannon: I believe that when I was on the council, we did regularly get those police reports. I think that you need that information to make an informed decision.
Councilman Redmond: I would like to add the Marleybone Pub to the separated list.
ORDINANCE FOR SECOND READING
ORD. #25-03 Cobble Stone or Belgium Block Curbing (To amend land development ordinance to have all new curbing to be installed that it be made of Belgium Block or Cobble Stone instead of concrete. (Replacement of existing curbs exempt herein).
Councilman Hoff: I do not understand the reasoning for this. Why we are thinking about making this change? Does this require a certain depth in the footing? I would like a little more information on this.
Mayor Cannon: This is for new construction and the idea is that Belgian Block curbing is a lot easier to replace. It can be replace by blocks instead of replacing the whole chunk. What we have now is a lot more expensive.
Councilman Hoff: Cobble stones are embedded only four to six inches. Concrete curbs go down lower.
Mr. Vincenti: The depth is similar for both curbs.
Councilman Hoff: I did not see the footing depths. I think that should be included in the ordinance.
Mr. Vincenti: It is, by reference, as well as the State Residential Improvement Standards.
Councilman Hoff: If they require the full footing, I have no problem.
Mr. Vincenti: It is a full footing.
Councilman Calogera: I put this ordinance together because after this winter I saw the damage that the plows did to the curbs. They are crumbling. I spoke to Rocky and John and we agree that the Belgian Block curbs last much longer and are stronger.
Councilman Hoff: I do not think they are stronger.
Councilman Redmond: Did this come from the planning board?
Councilman Calogera: This came from me and I took it to the planning board and it is back before council after the recommendation of the planning board.
Councilman Redmond: My only concern is when we have to take over the road, will the replacement of these curbs save us any money?
Mr. Donatelli: It is cheaper.
Councilman Hoff: I believe that there is nothing stronger and longer lasting than a concrete curb.

DISCUSSION ORDINANCE
DO-1 Ordinance authorizing clerk to deny permit applications and authorizing clerk to deny applications for permits in order to prevent dishonest business practices. (WSR)
Attorney Ruggierio: I have been called over to the clerk’s office a number of times in the past year where the clerk has tried to be judicious in the issuing of vendor permits. There are old ordinances in the code book where there are no standards for the clerk to make a judgment. This is just giving Rose-Marie the tools to make a more discriminating judgment.

Councilman Redmond: Does this hold up the schedule for the replacements.
Mr. Vincenti: We received three bids, two were very competitive and one was over the estimate. Our initial inclination was to award to the second lowest bidders, however, when we discussed it further we decided that it wasn’t prudent not to award to the lowest bidder. Our choices were to either award to the lowest bidder or reject and re-bid. We have a tentative bid opening the second week of July.
Councilman Redmond: Will we be able to cover what we had bonded for by the end of the season, even with this setback?
Mr. Vincenti: We will get significantly completed by the winter.

AUTHORIZING AWARD AND PROPOSAL FOR HVAC IMPROVEMENTS AT VETERANS PARK TO PETER KANELLAS AIR CONDITIONING & HEATING
BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, New Jersey that
Resolution #323-03
WHEREAS, the Township of Old Bridge received proposals for HVAC improvements to the Recreation Building at Veterans Park; and
WHEREAS, three proposals were received for these improvements; and
WHEREAS, the lowest responsible proposal was received from Peter Kanellas Air Conditioning & Heating; and
WHEREAS, the Township Council wishes to authorize and award the proposal for HVAC improvements at Veterans Park to Peter Kanellas Air Conditioning & Heating, located at 20-02 Linden Street, Oakhurst, New Jersey 07755.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Old Bridge, County of Middlesex, State of New Jersey, as follows:
1. Peter Kanellas Air Conditioning & Heating is hereby awarded the proposal for the HVAC improvements to the Recreation Building. The proposal for said improvements is the amount of $16,700.00.
2. The award of the proposal is contingent upon the issuance of a Certification of Availability of Funds #1147 certifying the existence of a sufficient appropriation to fund the said contract.
3. The Mayor and Township Clerk are hereby authorized to sign the contract documents necessary to effectuate the award of this contract. The Township Attorney shall review any and all contractual documents prepared in furtherance of this award.
This Resolution is conditioned upon the following:
A. Formal execution of a contract approved by the Director of Law which is signed by the Mayor and Township Clerk.
B. Issuance of a Certificate of Availability of Funds as aforesaid.

DISCUSSION
D-1 Pension Refunding - Early Retirement (HS)
Ms. Turchan: In 1991 the township authorized early retirement bonds for thirty years and there are eighteen years left on that bond. Every year our payment is going up 6%, between now and the time that the bond matures in 2021 we will have paid $1,263,000.00 – the present value of the bond is only $636,000.00 – with the market as favorable as it is now and the state authorizing early payoff, we have the option of paying this off early – which will save about $447,000.00 in interest. We would like to have your authorization to go ahead and issue the bond and then go to the local finance board to ask for permission to pay this off early. There was a memo sent to council with the payment schedule attached. We would like to pay interest in the first three years and then make one lump sum payment in the fourth year. According to our debt schedule; in four years our debt payments will substantially drop, so there would not be any issues about putting additional money into the debt service.
Councilman Hoff: That sounds like good planning and I would like to move this.
Councilman Greene: I would second that.
Councilman Baker: Does the administration support this plan?
Mayor Cannon: Yes.
Councilman Testino: You are putting the number to be raised from taxes in 2009.
Ms. Turchan: Actually we are not going to raise it in 2009 because in 2008 our total debt service will be $4,700,000.00 and after we make the 2008 payment our debt service drops to $3,300,000.00 – without this bond. So we really won’t need to raise additional money for this bond.
Councilman Testino: I would like to see where the money comes from, you are raising it from taxes one year as opposed to paying it out over twenty years.
Ms. Turchan: You already raised it because in 2008 you will have an obligation to make a debt service payment so you will have to raise that money. In 2009 you will use the exact same money that you already raised to make this payment.
Councilman Testino: That is assuming that we don’t cut the budget.
Ms. Turchan: Yes.
Councilman Testino: Are you looking for action tonight?
Ms. Turchan: No, I am just looking for authorization to prepare the bond ordinance.
Councilman Calogera: You said that our debt service will be lower, even with paying this?
Ms. Turchan: Yes.
Councilman Calogera: How much lower will this be after this payout?
Ms. Turchan: If we don’t do anything our debt service will drop $1,400,000.00 – if we make the payment of $650,000.00 our debt service will drop about $800,000.00.

Councilman Redmond: Why is there a special ruling?
Clerk Saracino: If your license is inactive for a period of two years it requires a special ruling from the director of the ABC to give permission to renew the license.
Councilman Redmond: Do these licenses ever fall back to us if they stay inactive for a time?
Clerk Saracino: Not on a consumption license, because you are over your limit.
Councilman Redmond: We are over our limit now and there are pocket licenses that are out there.
Clerk Saracino: At the time when that state deemed the number of license to be based on the 3.000 population figure, if you had over that number, you kept it. Any license that retires or dies is then gone.
Councilman Redmond: Can we say that these are now retired?
Clerk Saracino: You can, if you don’t want to renew the license.
Councilman Redmond: I don’t want licenses floating out there that we have to worry about, if we are already over the limit.
Clerk Saracino: If you don’t renew these, you will never get them back.
Councilman Redmond: I am looking to get rid of them.
Councilman Greene: I think that we should have representatives from these two inactive licenses at the meeting if we are thinking about not renewing these licenses.
Clerk Saracino: We will need to set up a hearing.
Councilman Greene: I don’t want a hearing, just have them answer some questions.
Clerk Saracino (to Attorney Ruggierio) Do we have to notify them that they need to bring counsel?
Attorney Ruggierio: There are three issues here – sometimes these pocket licenses exist because of bankruptcy which we cannot do anything about. You can always call a license owner before this body and have them make a presentation as to why you should not oppose this being carried as a pocket license. If your inclination is to oppose people maintaining licenses in their pocket, you can take that position, but due process requires you give them notice that you are formally proposing not to renew the license. You can either have them in for an informal presentation or you can have formal notice sent that you don’t intent to renew the license unless good cause is shown.
Councilman Redmond: The reason that I am asking these questions is because this is how we wound up in the Breakfast Club debacle. We all know that Arkay Bar, which was Hill Lanes no longer exists, suppose someone buys 51% of the stock in Hill Lanes, so now that only thing we can do is renew the license. I don’t want to be in that situation again – if they are inactive, lets take them off the books.
