The meeting was called to order at 6:40 p.m.
Salute to the flag was followed by roll call.
Statement was made that the meeting was held in accordance with the requirements of the Open Public Meeting Act.
Discussion was held regarding retaining of a redevelopment consultant. Patrick Gillespie informed the board that at the end of the last meeting we were going to solicit at least three other quotes from attorneys and then bring forth a recommendation to the board as to the best way to proceed.
A motion was made by Dave Merwin, seconded by Larry Redmond and unanimously agreed upon to retain Anne Babineau from Wilentz, Goldman & Spitzer at the range of rates that was outlined in her proposal to the EDC on an hourly basis without a retainer not to exceed amount of $10,000.
Mr. Azzarello will work out the billing details with Ms. Babineau i.e., travel time, meetings with the EDC.
A motion was made by Peter Davis, seconded by Kiran Desai, with one abstention, for the approval of the April Treasurer's Report and the May Bill List. The motion carried.
A motion was made by Edward Testino, seconded by Larry Redmond, with two abstentions, for the approval of the April 24, 2002 Meeting Summary with a correction on page three from "reinstate" to "restate". The motion carried.
Russell Azzarello gave a summary of his Director's Report and discussed various meetings held during the month and seminars attended.
Mr. Azzarello informed the board that after several meetings with the NJEDA there is a good chance the EDC could qualify for money for a feasibility study for the O&Y property.
Mr. Azzarello was the guest speaker at the Chamber of Commerce of Old Bridge, Sayreville & South Amboy meeting on May 15, 2002.
The Maser Consulting Group is doing a concept plan on the O&Y property through a group known as Ocean Front Acquisition. They are willing to do a very high conceptual design, at their expense, of what they think they can fit on the property.
A motion was made by Larry Redmond, seconded by Dave Merwin and unanimously agreed upon to accept the Director's Report.
Patrick Gillespie handed out the revised procedures for applicants appearing before the EDC. Criteria was included that we can use to measure pending applications or proposals that come before the board.
Thomas Downs, Attorney for the Board, was present to offer comments. He suggested we include under criteria for presentations - "may include but not limited to" - so we have some flexibility.
The only way to avoid "notice provision" with applications coming in to the EDC would be to change the membership of the Board.
The changes made to the procedures were as follows: add N.J.S.A. 40:55 to Number 1 and delete "at the request of the Board" in Number 7 on page 2.
A motion was made by Peter Davis, seconded by Mark Proudman and unanimously agreed upon to incorporate the changes to the procedures.
